The Meeker Drill Team has begun practice for the 4th of July festivities. We are in need of more riders to join us. AN ORDINANCE APPROVING THE ANNEXATION OF A CERTAIN PARCEL OF REAL PROPERTY OWNED BY WHITE RIVER ELECTRIC ASSOCIATION, INC, GENERALLY DESCRIBED AS: LYING IN SECTION 22, T1N,R94W OF THE 6TH P.M., RIO BLANCO COUNTY, COLORADO, TO THE TOWN OF MEEKER AND BRINGING SAID PARCEL OF REAL PROPERTY UNDER THE MEEKER ZONING ORDINANCE AND THE ZONING DISTRICT MAP OF THE TOWN OF MEEKER. AN ORDINANCE APPROVING THE REZONING OF A CERTAIN PARCEL OF REAL PROPERTY OWNED BY THE TOWN OF MEEKER, GENERALLY DESCRIBED AS: LYING IN SECTION 22, T1N, R94W OF THE 6TH P.M., RIO BLANCO COUNTY, COLORADO, ALSO KNOWN AS A PORTION OF THE UTE PARK TRIANGLE PARCEL, LYING BETWEEN MAIN STREET AND COLORADO HIGHWAY 13, AND AMENDING THE ZONING DISTRICT MAP OF THE TOWN OF MEEKER. WHEREAS, the Town owns Ute Park, a portion of which is a triangular shaped parcel of land, lying north of Colorado Highway 13 and south of Main Street, (Ute Park Triangle Parcel); and, WHEREAS, pursuant to the Memorandum of Understanding (MOU) between the Town and White River Electric Association, Inc. (WREA), approved pursuant to Resolution No. 2, Series 2012, a certain portion of the Ute Park Triangle Parcel, to be created pursuant to M.M.C. 17.1.111(B), and referred to in the MOU as the “Subject Property”, more particularly described in Exhibit A, attached hereto and incorporated herein by this reference, is to be sold to the WREA and, thereafter, to be consolidated, pursuant M.M.C. 17.1.111(B), with a parcel of real property owned by WREA (WREA Parcel), which lies immediately east of and shares a common property line with the easterly property line of the Subject Property; and, WHEREAS, as provided by the MOU, the WREA Parcel has been annexed to the Town and given a zone district designation of Highway Commercial District (HC), pursuant to Ordinance 2, Series 2012, and the Town has made application for the rezoning of the Subject Property from its current Open District (O) zone district designation to the same zone district designation given to the WREA Parcel; and, WHEREAS, the Planning Commission held a public hearing on March 26, 2012 concerning the rezoning of the Subject Property, public notice of which was duly given in the Rio Blanco Herald Times newspaper, and the recommendation of the Planning Commission to the Town Board was to rezone the Subject Property as Highway Commercial District (HC), as provided by the Meeker Zoning Ordinance, and identical to the zone district designation authorized by the Town Board for the WREA Parcel in Ordinance No. 2, Series 2012; and, WHEREAS, a public hearing was held on the 17th day of April, 2012, before the Town Board at its regular meeting, held at the Meeker Town Hall, 345 Market Street, Meeker, Colorado, public notice of which was duly given in the Rio Blanco Herald Times newspaper; and, WHEREAS, the public was, at such public hearing, given the opportunity to voice its opinions regarding the proposed rezoning of the Subject Property, which opinions have been given full consideration by the Town Board; and, WHEREAS, the Town Board on the basis of the evidence produced at the public hearing makes the following determinations of fact; 1) That the proposed rezoning request has met the requirements of the laws of the State of Colorado and the ordinances of the Town; and, 2) That the hearing before the Town Board was complete and all persons had an opportunity to speak; and, 3) That all pertinent facts, matters and issues were submitted for its consideration; and, 4) That the proposed rezoning of the Subject Property to a zone district designation of Highway Commercial District (HC) is appropriate, as recommended by the Planning Commission, and is consistent with the terms and conditions of the MOU. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO, that: Section I The Town’s application for rezoning of the Subject Property is hereby approved and the Subject Property’s zoning is designated Highway Commercial District (HC). Furthermore, it is hereby authorized that a corresponding amendment be made to the Zoning District Map of the Town of Meeker, Colorado showing the rezoning of the Subject Property. Section II: The provisions of this ordinance are severable, and if any provision is held invalid, the remaining provisions shall not be affected, but shall remain in full force and effect. Section III: The Mayor and Town Clerk are hereby directed to execute this Ordinance. Section IV This ordinance shall become effective thirty (30) days after the date of publication. Ordinance NO. 4 Series 2012. AN ORDINANCE REPEALING, AMENDING, AND REENACTING THE MEEKER MUNICIPAL CODE, TITLE 17, MEEKER SUBDIVISION ORDINANCE.
