Ordinance No. 3, Series 2009 AN ORDINANCE PROVIDING FOR THE REVISION OF THE UTE PARK MASTER PLAN TO AUTHORIZE THE INSTALLATION OF UNDERGROUND ELECTRIC SERVICE. WHEREAS, the Town of Meeker, the “Town”,owns Ute Park; and, WHEREAS, subsequent to the Town’s acquisition of Ute Park, the Town Board of Trustees, the “Town Board”, undertook a development study of said parcel of land, now known as the Ute Park – Master Plan, the “Master Plan”; and, WHEREAS, in addition to providing open space and a park setting, Ute Park has been the venue for various community events and will continue to be used for such purposes and it is the Town Board’s intent to broadenthe public’s use of Ute Park, consistent with the Master Plan; and, WHEREAS, at the Town Board meeting on July 21, 2009, the Town Board heard a request from the Smoking River Pow Wow Committee to make an improvement in Ute Park in order to facilitate and accommodate the public use of Ute Park, to-wit: the installation of underground electric service to the area adjacent to the dance ring used during the Smoking River Pow Wow; and, WHEREAS, the Town Board determined it would be necessary and in the best interest of the Town and its citizens to hold a public hearing to consider said proposals and their compatibility with the Master Plan; and, WHEREAS, a public hearing was held on August 4, 2009, at a regular Town Board meeting at Town Hall, 345 Market Street, Meeker, Colorado, to which hearing public notice was given by posting at the Meeker Town Hall and the Meeker United States Post office on July 30, 2009;and, WHEREAS, the public was, at such public hearing, given the opportunity to voice its opinion regarding said proposal; and, WHEREAS, the representatives of the Smoking River Pow Wow Committee presented their proposal concerning a modification to the Master Plan, including: the installation of underground electric service to the area adjacent to the dance ring (the big rock) used during the Smoking River Pow Wow, all to be installed and constructedat no cost to the Town; and, WHEREAS, on the basis of the evidence produced at said public hearing, the Town Board made the following determinations of fact: 1) the public hearing concerning the proposal, as described herein above, has met the requirements of the laws of the State of Colorado and the ordinances of the Town; and, 2) the hearing before the Board was complete and that all persons had an opportunity to speak; and, 3) the proposed improvement would serve the needs of the Smoking River Pow Wow and those of Ute Park; and, 4) the proposed improvement on the designated portion of Ute Park would result in minimal impacts to the site; would facilitate the public’s use of Ute Park for the Smoking River Pow Wow and other events held therein; are consistent with the Master Plan; and are in the best interest of the public health, safety, and welfare of the Town, its citizens, and the persons using Ute Park. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO: Section I: That the Ute Park Master Plan is hereby revised and modified to provide, as follows: the underground electric service is authorized to be installed tothe existing Smoking River Pow Wow dance ring, in the vicinity of the big rock. The underground electric service will be installed so that all improvements will be placed at or below existing ground level, with no improvements installed above existing ground level. Furthermore, the Town Board hereby acknowledges the generous donations by White River Electric Association and Ducey’s Electric to the Smoking River Pow Wow that will make this project possible. FURTHERMORE, BEIT ORDAINED that the Town Administrator and the Public Works Department Superintendent are hereby authorized to take any and all action necessary, as deemed necessary in the best interests of the Town, to oversee and direct the authorized improvement work so that it is installed in a manner consistent with the provisions of this ordinance. Section II: It is the intention of the Town Board of Trustees of the Town of Meeker that each separate provision of this ordinance shall be deemed independent of all other provisions therein. If any section, subsection, sentence, clause, phrase, or a portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, each subsection, sentence, clause, phrase, or portion thereof shall be deemed a separate, distinct, and independent provision, and such holding shall not affect, impair, or nullify the validity of the remaining portions thereof. Section III: The Mayor and Town Clerk are hereby directed to execute this ordinance. Section IV: This ordinance shall take effect thirty (30) days after the date of publication of this ordinance. MEEKER SANITATION DISTRICT SENIOR CITIZEN SEWER RATE REDUCTION PROGRAM If you live in a household with one family member who is 64 years or older, as shown by a birth certificate, school records, and military discharge documents or other supporting documentation acceptable to the Meeker Sanitation District, you may qualify for a reduced sewer rate. Eligible households will receive a discount on their sewer bill each month. To qualify for the program, the total gross family income for all residents of the household must be less than one thousand, four hundred, sixty four dollars and seventy eight cents per month ($1,464.78) or seventeen thousand, five hundred, seventy seven dollars and thirty eight cents per year ($17,577.38) as evidenced by the federal income tax returns for all household members for the year 2008. In compliance with the U.S. Environmental Protection Agency (EPA) Asbestos Hazard Emergency Response Act (AHERA), in the summer of 1988 we performed inspections of each of our school buildings for asbestos containing building materials. The inspection findings and asbestos management plans have been on file in each school administration office since that time. The EPA requires us to perform re-inspection of the asbestos materials every three years. During the month of July 2009, we will be performing a 6-month review. An accredited asbestos inspector will perform these inspections. An accredited management planner will review the results of the inspections and recommend actions we should take to safely manage each asbestos material in our buildings.
