The Piceance Creek Unit 63-17 Injection well is located 1911 feet from the North line and 1396 feet from the West line of Section 17, Township 2 South, Range 97 West, 6th P.M., Rio Blanco County, Colorado. Class II injection wells are permitted to inject waste generated from oil and gas exploration and production operations. LEGAL NOTICES: ORDINANCE NO. 2 Series 2009 AN ORDINANCE REZONING PARCEL A, AS SHOWN ON THE ESCONDIDO SUBDIVISION FINAL PLAT, OWNED BY BUDDY L. AND PATRICIA E. THOMPSON. WHEREAS, the Escondido Subdivision Final Plat, filed for recording in the office of the Rio Blanco County Clerk and Recorder, as Reception No 295158, created Parcel A, which parcel of land was proposed by the Owners and Developers of the Escondido Subdivision to be conveyed to Buddy L. and Patricia E. Thompson, the “Thompsons”, who are the owners of the adjoining Lots 2, 3, and 4, Block 5 of the Sage Hills Subdivision, as shown on the plat thereof filed for recording in the office of the Rio Blanco County Clerk and Recorder, as Reception No. 196641, the “Thompsons’ Sage Hills Lots”, all as setforth in the Town of Meeker Board of Trustee’s, the “Town Board”, Motion Approving the Escondido Subdivision Final Plat, the “Motion”; and, WHEREAS, the Town Board’s Motion, also, provided that upon the conveyance of the rights, title, and interest in and to Parcel A to the Thompsons, that the Thompsons would apply to the Town for: the rezoning of Parcel A from RR Rural Residential District to R-1A Single-Family Residential District and the administrative lot consolidation of Parcel A with Thompsons’ Sage Hills Lots (as provided by M.M.C. 17.1.111), in order to form one consolidated lot; and, WHEREAS, Thompsons have filed with the Town the following documents: a copy of the deed evidencing their ownership of Parcel A; the Town applications for the rezoning of Parcel A and the administrative lot consolidation of Parcel A with the Thompsons’ Sage Hills Lots; the proposed Lot Consolidation Plat SAGE HILLS RESUBDIVISION for Parcel A and the Thompsons’ Sage Hills Lots; and the applicable Town application fees; and, WHEREAS, the Town Planning Commission held a public hearing for the rezoning of Parcel A, pursuant to M.M.C. 18.1.148, and based upon the evidence presented at said public hearing and upon the recommendation of the Town planner, the Town Planning Commission has recommended to the Town Board that it consider the adoption of an ordinance approving the rezoning of Parcel A from RR Rural Residential District to the R-1A Single-Family Residential District, which designation would be consistent with the current zoning district designation of the Thompsons’ Sage Hills Lots; and, WHEREAS, at the Town Board meeting on May 19, 2009, the Town Board held a public hearing, to which public hearing, public notice was duly given in the Rio Blanco Herald Times newspaper, to consider the recommendation of the Town Planning Commission to rezone Parcel A to the R-1A Single-Family Residential District in order to facilitate the administrative lot consolidation of Parcel A with the Thompsons’ Sage Hills Lots, WHEREAS, the Town planner, further, informed the Town Board that upon the passage, adoption and approval of an ordinance rezoning Parcel A, that she will complete the review of the proposed Parcel A administrative lot consolidation with the Thompsons’ Sage Hills Lots, thereby, creating a new Lot2-4-A and the vacation of the side lot line utility easements on either side of the common lot lines of the Thompsons’ Sage Hills Lots, as shown on the proposed Lot Consolidation Plat SAGE HILLS RESUBDIVISION, prepared by JSC, Inc. and submitted by the Thompsons; and, WHEREAS, the public was given the opportunity to voice its opinions concerning the proposed rezoning of Parcel A, which opinions have been given full consideration by the Board; and, WHEREAS, the Town Board on the basis of the evidence produced has made the following determination of fact that the rezoning of Parcel A from RR Rural Residential District to R-1A Single-Family Residential District, thereby, facilitating the administrative lot consolidation of Parcel A and the Thompsons’ Sage Hills Lots, would be consistent with the Town’s Comprehensive Plan and the terms and conditions of the Motion and would be in the best interests of the public health, safety, and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO: Section 1: That Parcel A, as shown on the Escondido Subdivision Final Plat, as described hereinabove, is hereby rezoned to the R-1A Single-Family Residential District designation. Section II: The Mayor and Town Clerk are directed to execute this ordinance. Section III: The Town planner is directed to file this ordinance for recording in the office of the Rio Blanco County Clerk and Recorder, subsequent to its adoption. Furthermore, the Town planner is hereby authorized to make the necessary amendment to the Town Zoning Map to reflect the rezoning authorized herein, as provided by M.M.C. Title 18, Meeker Zoning Ordinance. Section IV: This ordinance shall become effective thirty (30) days after the date of publication of this ordinance.
