The fine for a first offense and any subsequent offense shall be One Thousand Dollars ($1,000.00) per violation, and each day is a separate violation. 6. Unless otherwise provided by law all fines and penalties and any surcharges thereon, for the violation of this Ordinance shall be paid into the treasury of Rio Blanco County. 7. In addition to the fines and penalties described in this Ordinance, any person convicted of a violation of this Ordinance shall be subject to the statutory surcharge of Ten Dollars ($10.00) for the Victims and Witnesses Assistance and Law Enforcement Fund. This surcharge shall be paid to the Clerk of Court by each person convicted of violating this Ordinance. The Clerk of Court shall transmit the money in accordance with Section 30-15-402(2) C.R.S. 8. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.
