Notice of Decision Lower Fawn and Moeller Creek/Lost Park Grazing Allotments Environmental Assessment, White River National Forest, Blanco Ranger District, Rio Blanco County The Blanco District Ranger, Ken W. Coffin, signed a Decision Notice (DN) and Finding of No Significant Impact (FONSI) on January 12, 2011 approving the proposed action as identified in the Lower Fawn and Moeller Creek/Lost Park Grazing Allotments Environmental Assessment. The selected alternative will best meet the purpose and need as described in the DN/FONSI and will meet the White River National Forest Land and Resource Management Plan (LRMP) – 2002 Revision objectives for range management. ORDINANCE NO. 1, Series 2011 – AN ORDINANCE AMENDING THE MEEKER MUNICIPAL CODE, TITLE 6, CHAPTER 1, BY THE ADDITION OF A NEW SECTION 6.1.122.1, SPAY AND NEUTER OF OWNERLESS DOGS PRIOR TO RELEASE FOR ADOPTION; ADDING NEW DEFINITIONS TO CHAPTER 6.1; AMENDING SECTION 6.1.106, LICENSE – FEE; AMENDING AND REENACTING §6.1.116, NOTICE TO OWNER AND REDEMPTION OF DOG; REPEALING AND REENACTING SECTION 6.1.117, BY PROVIDING FOR A MINIMUM TIME LIMIT FOR HOLDING DOGS IN THE TOWN ANIMAL SHELTER, THE DISPOSITION OF UNCLAIMED DOGS AND IMMUNITY FROM ACTION OVER THE DISPOSITION OF DOGS; REPEALING SECTION 6.1.118, Unclaimed Dogs; AND PROVIDING FOR AN EMERGENCY ADOPTION AND AN EFFECTIVE DATE. WHEREAS, the Colorado Legislature adopted C.R.S. §35-80-106.4 Sterilization of ownerless dogs and cats required-rules-exceptions-violation and the Town wishes to comply with this state mandate; and, WHEREAS, at its regular meeting on January 18, 2011, the Town Administrator informed the Town Board of Trustees, the “Town Board”, that C.R.S. §35-80-106.4 had been enacted requiring all animal shelters, such as the Town’s animal shelter, to provide for the sterilization of ownerless dogs, by a licensed veterinarian, prior to the release of such dogs to a prospective owner and other revisions are necessary to the Meeker Municipal Code, (M.M.C.) Title 6, chapter 1, Dogs, in order to conform to the provisions of state law; and, WHEREAS, the Town Board at its regular meeting at the Meeker Town Hall, 345 Market Street on January 18, 2011, held a public hearing to consider the adoption of a proposed ordinance to implement a spaying and neutering program for the Town; amending the definitions of M.M.C. Title 6, chapter 1; providing for a minimum time limit to hold dogs in the Town animal shelter; providing for the disposition of unclaimed dogs and providing for immunity from action over the disposition of dogs for Town employees, and amending and repealing certain portions of said chapter 1 and it was the recommendation of the Town staff that the Town Board consider the adoption of such regulations; and, WHEREAS, public notice for the public hearing held on January 18, 2011 was given in the Rio Blanco Herald Times newspaper, published on January 13, 2011; and, WHEREAS, the public, at such hearing, was given the opportunity to voice its opinion regarding the proposed spaying and neutering of ownerless dogs prior to their release for adoption and the other portions of Title 6, chapter 1 subject to amendment, repeal or reenactment, described herein above; and, WHEREAS, the Town Board on the basis of the evidence produced at the public hearing has made the following determination of fact:1. The proposed regulations have met the requirements of the laws of the State of Colorado and the ordinances of the Town; and, 2. That the hearing before the Town Board was complete and all persons had an opportunity to speak; and,3. That the proposed program for the spaying and neutering of ownerless dogs prior to their release from the Town animal shelter will assist in reducing the overpopulation of stray dogs in the Town; and, 4. That all of the proposed amendments to M.M.C. Title 6, chapter 1 are in the best interest of the public health, safety, and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO: Section I. Meeker Municipal Code §6.1.122.1, Spay or neuter of ownerless dogs released for adoption from the Town animal shelter shall be and hereby is enacted to read as follows (capital letters indicate new material added to existing ordinances): (A) IT IS THE PURPOSE OF THIS SECTION TO PROMOTE THE HEALTH, SAFETY, AND GENERAL WELFARE OF THE RESIDENTS OF THE TOWN BY REDUCING THE OVERPOPULATION OF STRAY DOGS. THE TOWN BOARD FINDS THAT EACH YEAR STRAY OR OWNERLESS DOGS ARE IMPOUNDED BY THE TOWN AND EITHER, PLACED FOR ADOPTION OR EUTHANIZED. IT IS THE PURPOSE OF THIS SECTION TO ELIMINATE THIS OVERPOPULATION OF DOGS BY IMPLEMENTING REASONABLE AND ENFORCEABLE LEGISLATION TO PROVIDE FOR THE STERILIZATION OF OWNERLESS DOGS. (B) ALL DOGS ADOPTED FROM THE TOWN ANIMAL SHELTER SHALL NOT BE RELEASED TO THE PROSPECTIVE OWNER UNLESS:I) THE DOG HAS BEEN STERILIZED BY A LICENSED VETERINARIAN; OR,II)(a) THE PROSPECTIVE OWNER SIGNS A TOWN ADOPTION AGREEMENT TO HAVE THE DOG STERILIZED BY A LICENSED VETERINARIAN WITHIN NINETY (90) DAYS AFTER THE DATE OF THE RELEASE OF THE DOG AND DEPOSITS A STERILIZATION DEPOSIT FEE AND PAYS A NON-REFUNDABLE TOWN DOG ADOPTION FEE, IN AMOUNTS SPECIFIED BY A RESOLUTION OF THE TOWN BOARD. THE WRITTEN TOWN DOG ADOPTION AGREEMENT SHALL BE IN A FORM APPROVED BY THE TOWN BOARD AND SHALL INCLUDE, AT LEAST THE FOLLOWING: AGE (IF KNOWN), SEX, BREED, AND GENERAL DESCRIPTION OF THE DOG; DATE OF ADOPTION AND DATE BY WHICH THE DOG MUST BE STERILIZED; IF THE TIME FOR STERILIZATION HAS BEEN EXTENDED, AS PROVIDED BY SUBSECTION (B)(III), THEN THE NEW DATE BY WHICH THE DOG MUST BE STERILIZED; ADOPTING PARTY’S NAME, ADDRESS, MAILING ADDRESS, TELEPHONE/CELLULAR NUMBER, AND SIGNATURE; AND THE FOLLOWING SHELTER INFORMATION: TOWN OF MEEKER, 345 MARKET STREET, TELEPHONE: 970-878-5181. (b) UPON RECEIVING A WRITTEN STATEMENT FROM THE LICENSED VETERINARIAN, WHO PERFORMED THE STERILIZATION PROCEDURE, THAT THE DOG HAS BEEN STERILIZED AS PROVIDED BY THIS SECTION, THE TOWN SHALL REFUND THE STERILIZATION DEPOSIT FEE TO THE PROSPECTIVE OWNER. THE REFUNDED STERILIZATION DEPOSIT FEE IS TO BE MAILED TO THE PROSPECTIVE OWNER’S ADDRESS SHOWN ON THE TOWN’S DOG ADOPTION AGREEMENT. (c) IF THE PROSPECTIVE OWNER FAILS TO PROVIDE THE TOWN ANIMAL SHELTER WITH A WRITTEN STATEMENT FROM A LICENSED VETERINARIAN STATING THAT THE LICENSED VETERANIAN PERFORMED THE STERILIZATION PROCEDURE ON THE DOG WITHIN NINETY (90) DAYS OF THE DATE OF THE TOWN DOG ADOPTION AGREEMENT, THEN THE PROSPECTIVE OWNER SHALL FORFEIT THE STERILIZATION DEPOSIT FEE AND IT SHALL BECOME THE SOLE PROPERTY OF THE TOWN. THEREAFTER, EACH YEAR UPON THE TOWN’S LICENSE RENEWAL WITH THE COLORADO DEPARTMENT OF AGRICULTURE, ALL STERILIZATION DEPOSIT FEES, HELD BY THE TOWN, WILL BE FORWARDED TO THE COLORADO PET OVERPOPULATION FUND, CREATED BY C.R.S. §35-80-116.5(5) OR A LOCAL DEDICATED SPAY AND NEUTER FUND, AS DESIGNATED BY A RESOLUTION OF THE TOWN BOARD OF TRUSTEES, AS MAY BE ADOPTED FROM TIME TO TIME.(III) IF A LICENSED VETERINARIAN DECLARES IN WRITING THAT A STERILIZATION PROCEDURE COULD JEOPARDIZE THE LIFE OR HEALTH OF THE DOG, THE STERILIZATION PROCEDURE MAY BE DELAYED UNTIL SUCH TIME THAT A LICENSED VETERINARIAN DETERMINES THAT THE DOG IS FIT TO UNDERGO THE STERILIZATION PROCEDURE. IN SUCH EVENT, THE TOWN MAY EXTEND THE ORIGINAL NINETY (90) DAY PERIOD FOR THE DOG’S STERILIZATION PROCEDURE. THE EXTENSION DATE FOR THE STERILIZATION PROCEDURE SHALL BE NOTED ON THE ORIGINAL TOWN DOG ADOPTION AGREEMENT. AT SUCH TIME, THE PROSPECTIVE OWNER SHALL HAVE THE DOG STERILIZED. DURING THE EXTENSION OF THE TIME FOR THE STERILIZATION PROCEDURE THE TOWN SHALL CONTINUE TO HOLD THE PROSPECTIVE OWNER’S STERILIZATION DEPOSIT FEE AND ITS REFUND OR FORFEITURE SHALL BE SUBJECT TO THE PROVISIONS OF SUBSECTIONS (B)(II)(b) OR (c), RESPECTIVELY. IF THE DETERMINATION OF THE UNFITNESS FOR STERILIZATION HAS BEEN MADE PRIOR TO THE RELEASE OF THE DOG FROM THE TOWN ANIMAL SHELTER, THE TOWN ANIMAL SHELTER MAY RELEASE THE DOG TO THE PROSPECTIVE OWNER, SUBJECT TO THE PROVISIONS OF THIS SUBSECTION (III). (C) THIS SECTION SHALL NOT APPLY TO:(I) THE RELEASE OF A DOG TO THE DOG’S OWNER, THAT IS, A PERSON WITH PRIOR AND CONTINUING OWNERSHIP OF THE DOG WHO IS RECLAIMING THE DOG FROM THE TOWN ANIMAL SHELTER; OR,(II) THE TRANSFER OF THE DOG FROM THE TOWN ANIMAL SHELTER TO ANOTHER ANIMAL SHELTER OR PET ANIMAL RESCUE OR TO A LICENSED VETERINARIAN.(C) NOTHING IN THIS SECTION SHALL PLACE RESPONSIBILITY OR LIABILITY FOR THE DOG’S ACTIONS OR HEALTH UPON THE TOWN FOR ANY INCIDENT ARISING SUBSEQUENT TO THE DATE OF ADOPTION OF THE DOG BY THE PROSPECTIVE OWNER. FAILURE OF THE PROSPECTIVE OWNER ADOPTING A DOG TO STERILIZE IT IS A VIOLATION OF THIS CHAPTER. Section II. Meeker Municipal Code §6.1.101, Definitions shall be and hereby is amended to read as follows (capital letters indicate new material added to existing ordinances):The following sentence is repealed: “For the purpose of this chapter certain terms and words are defined as follows:” and shall be amended and read as follows: “AS DEFINED IN THIS TITLE, UNLESS THE CONTEXT OTHERWISE REQUIRES, THE FOLLOWING TERMS, PHRASES, WORDS AND THEIR DERIVATION SHALL HAVE THE MEANING GIVEN HEREIN. The following new definitions shall be added and read as follows: A. “ABANDON” MEANS THE LEAVING OF AN ANIMAL WITHOUT ADEQUATE PROVISIONS FOR THE ANIMAL’S PROPER CARE BY ITS OWNER, THE PERSON RESPONSIBLE FOR THE ANIMAL’S CARE OR CUSTODY, OR ANY OTHER PERSON HAVING POSSESSION OF SUCH ANIMAL.B. “ANIMAL” MEANS ANY LIVING DUMB CREATURE.C. “ANIMAL SHELTER” MEANS THE TOWN’S FACILITY LICENSED OR OTHER LICENSED FACILITY, PURSUANT TO ARTICLE 80 OF TITLE 35, C.R.S. AND THE RULES AND REGULATIONS PERTAINING TO THE ADMINISTRATION AND ENFORCEMENT OF THE PET ANIMAL CARE AND FACILITIES ACT, 8 CCR 1201-11.D. “DAYS” FOR PURPOSES OF THIS TITLE 6, MEANS MONDAYS THROUGH FRIDAYS AND SHALL NOT INCLUDE SATURDAYS, SUNDAYS, OR LEGAL HOLIDAYS, OBSERVED BY THE TOWN.G. “DISPOSAL” OR “DISPOSITION” MEANS ADOPTION OF A DOG; RETURN OF A DOG TO THE OWNER; RELEASE OF A DOG TO A RESCUE GROUP LICENSED PURSUANT TO ARTICLE 80 OF TITLE 35, C.R.S.; RELEASE OF A DOG TO ANOTHER PET ANIMAL FACILITY LICENSED PURSUANT TO ARTICLE 80 OF TITLE 35, C.R.S.; OR EUTHANASIA OF A DOG.H. “EUTHANASIA” MEANS TO PRODUCE A HUMANE DEATH BY TECHNIQUES ACCEPTED BY THE AMERICAN VETERINARY MEDICAL ASSOCIATION.J. “LICENSED VETERINARIAN” MEANS A PERSON WHO IS LICENSED TO PRACTICE VETERINARY MEDICINE IN STATE OF COLORADO PURSUANT TO ARTICLE 64 OF TITLE 12, C.R.S.L. “PET ANIMAL RESCUE” MEANS ANY PERSON LICENSED PURSUANT TO ARTICLE 80, TITLE 35, C.R.S., WHO ACCEPTS DOGS FOR THE PURPOSE OF FINDING PERMANENT ADOPTIVE HOMES FOR ANIMALS AND DOES NOT MAINTAIN A CENTRAL FACILITY FOR KEEPING ANIMALS, BUT RATHER USES A SYSTEM OF FOSTERING IN PRIVATE HOMES OR BOARDING OR KEEPING DOGS IN LICENSED PET ANIMAL FACILITIES, AS THIS TERM IS DEFINED IN C.R.S.§35-80-102(11).M. “PROSPECTIVE OWNER” MEANS A PERSON WHO HAS NO PRIOR RIGHTS OF OWNERSHIP TO THE DOG TO BE ADOPTED.O. “RELEASE” MEANS ADOPTION, SALE, OR OTHER TRANSFER TO THE PERMANENT CUSTODY OF AN OWNER BY THE TOWN ANIMAL SHELTER.Q. “STERILIZATION” 0R “STERILIZED” MEANS THE ACT OF PERMANENTLY RENDERING AN ANIMAL INCAPABLE OF REPRODUCTION. THE TERM APPLIES TO SURGICAL METHODS, INCLUDING THE PROCEDURES COMMONLY REFERRED TO AS SPAY AND NEUTER, AND NONSURGICAL METHODS AND TECHNOLOGIES APPROVED BY THE UNITED STATES FOOD AND DRUG ADMINISTRATION, THE UNITED STATES DEPARTMENT OF AGRICULTURE, OR OTHER APPROPRIATE DESIGNATED FEDERAL AUTHORITY. Section III. Meeker Municipal Code §6.1.106, License – Fee, shall be and hereby is amended and reenacted to read as follows (bold or capital letters or numbers indicate new materials added to existing ordinances; dashes through words indicate deletions from existing ordinances):”Dog licenses shall be issued by the Town Clerk upon the payment of a license fee of five dollars ($5.00) for each castrated STERILIZED male or spayed female dog and fifteen dollars ($15.00) for any uncastrated UNSTERILIZED male or unspayed female dog. …”Section IV.Meeker Municipal Code §6.1.116 Notice to Owner and Redemption of Dog. shall be and hereby is amended and reenacted to read as follows (bold or capital letters or numbers indicate new materials added to existing ordinances; dashes through words indicate deletions from existing ordinances): “No later than two (2) calendar days after impounding any dog, the owner shall be notified, or if the owner of the dog is unknown, written notice shall be posted for three (3) FIVE (5) consecutive business days at the Town Hall, describing the dog and the place and time of taking. …”Section V. Meeker Municipal Code §6.1.117 Disposition of unclaimed or infected dogs. shall be and hereby is repealed and reenacted to read as follows (capital letters indicate new material added to existing ordinances.):Disposition of unclaimed or infected dogs. DOG HOLDING PERIODS – DISPOSITION OF UNCLAIMED DOGS – IMMUNITY FROM ACTIONS OVER DISPOSITION OF DOGS.A. ANY DOG HELD IN THE CUSTODY OF THE TOWN ANIMAL SHELTER AND NOT CLAIMED BY THE OWNER SHALL BE HELD BY THE ANIMAL SHELTER FOR A MINIMUM OF FIVE (5) DAYS AFTER ACQUISITION BY THE TOWN ANIMAL SHELTER AND THE DOG MAY BECOME AVAILABLE FOR ADOPTION OR OTHERWISE DISPOSED OF AT THE DISCRETION OF THE ANIMAL SHELTER. IF THE TOWN ANIMAL SHELTER ACQUIRES THE DOG FROM THE OWNER OR THE AUTHORIZED REPRESENTATIVE OF THE OWNER, THE DOG BECOMES THE PROPERTY OF THE TOWN AT THE TIME OF TRANSFER OF THE DOG, AS PROVIDED IN M.M.C. §6.1.122, AND THE DOG MAY BE DISPOSED OF BY AND AT THE DISCRETION OF THE TOWN ANIMAL SHELTER. IF THE DOG IS ABANDONED, THE DOG BECOMES THE PROPERTY OF THE TOWN ANIMAL SHELTER UPON ACQUISITION AND MAY BE DISPOSED OF BY AND AT THE DISCRETION OF THE TOWN ANIMAL SHELTER. THE TOWN ANIMAL SHELTER MAY BE THE STEWARD OF A STRAY DOG FOR THE PURPOSED OF PROVIDING PROTECTIVE VETERINIARY CARE, AS THE TOWN ANIMAL SHELTER DETERMINES MAY BE NECESSARY. DOGS, WHICH IN THE OPINION OF A LICENSED VETERINARIAN OR THE CHIEF OF POLICE OR THE TOWN ADMINISTRATOR, IF A LICENSED VETERINARIAN IS NOT AVAILABLE, ARE EXPERIENCING EXTREME PAIN OR SUFFERING, MAY BE DISPOSED OF IMMEDIATELY BY THE TOWN ANIMAL SHELTER THROUGH EUTHANASIA AFTER THE TOWN ANIMAL SHELTER HAS EXHAUSTED REASONABLE EFFORTS TO CONTACT THE OWNER OF THE DOG; HOWEVER, FOR DOGS WITH IDENTIFICATION, INCLUDING BUT NOT LIMITED TO A MICROCHIP OR A COLLAR WITH IDENTIFICATION TAGS, THE TOWN ANIMAL SHELTER SHALL EXHAUST REASONABLE EFFORTS TO CONTACT THE OWNER OF THE DOG FOR UP TO TWENTY-FOUR (24) HOURS.B. IF THE DISPOSITION OF A DOG FROM THE TOWN ANIMAL SHELTER IS BY ADOPTION, THE PROSPECTIVE OWNER SHALL PAY THE TOWN ADOPTION FEE AND SIGN THE TOWN ADOPTION AGREEMENT PRIOR TO THE TRANSFER OF THE DOG, AS PROVIDED BY THIS CHAPTER 1. IN THE EVENT THE TOWN ANIMAL SHELTER DETERMINES THAT THE DOG HAS BEEN PREVIOUSLY SPAYED OR NEUTERED, AS PROVIDED BY M.M.C. §6.1.122.1, THEN THE PROSPECTIVE OWNER SHALL NOT BE REQUIRED TO PAY THE STERILIZATION DEPOSIT FEE OR COMPLY WITH THE STERILIZATION PROVISIONS OF M.M.C. §6.1.122.1.C. Section X: The Town Board finds, determines, and declares that passage of this ordinance is necessary for the immediate preservation of the public peace, health and safety by ensuring that a prospective owner adopting a dog from the Town animal shelter complies with the mandated of C.R.S. §35-80-106.4 concerning the sterilization of any dog and the payment of the required deposit as described in this ordinance. Furthermore, such passage of this ordinance will ensure that the M.M.C. Title 6, chapter 1 and the Town’s animal shelter, which is licensed by the Colorado Department of Agriculture, remain in compliance with state law and the Colorado Department of Agriculture, Rules and Regulations Pertaining to the Administration and Enforcement of the Pet Animal Care and Facilities Act, 8 CCR 1201-11. This ordinance shall be effective upon its adoption. Mobley will play in All State games. Coach Klark Kindler was named Western Slope Coach of the Year. Left to right: Bryan Rosas, Simonsen, Quinn, Fitzgibbons, Mobley and Sullivan.

  • Mormon crickets have hatched near Rangely. They were all sighted on BLM land north of Hwy. 64 near the junction of CR 96 and CR 1, down a dirt road near the Moffat County line.  The picture shown was taken yesterday by Mary Meinen from Rangely. She says the crickets are about the size of a ladybug (less than 1/2”). Some of them are actually yellow in color but most of them are darker. They are milling around and getting ready to start moving soon. Note: Photo is not to scale.
Rio Blanco County and the White River and Douglas Creek Conservation Districts are still asking for your help to identify additional hatch-outs of crickets so that control efforts can be put in place. The success of the program will highly depend upon local landowners and the public helping to locate crickets as soon as they hatch.  See last week’s paper for a list of ways to help or contact the County Weed & Pest District at 970-878-9670 or the Conservation District office at 970-878-9838 with any questions.
