OIL AND GAS CONSERVATION COMMISSION OF THE STATE OF COLORADO NOTICE OF PROPOSED DESIGNATION OF THE OHIO CREEK FORMATION AS AN EXEMPT AQUIFER TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN: Koch Exploration Company, LLC, has filed an application for approval to inject water into the Ohio Creek Formation in the AHU Wyatt 25-43 SWD well. The AHU Wyatt 25-43 SWD well is located 441 feet from the South line and 1,959 feet from the East line of Section 25, Township 2 North, Range 97 West, 6th P.M., Rio Blanco County, Colorado. The Ohio Creek Formation is found at an approximate depth of 3,033 feet to 3,245 feet in the AHU Wyatt 25-43 SWD well. A water quality sample of the injection formation has a concentration of 3,100 milligrams per liter total dissolved solids. Based on the data supplied by Koch Exploration Company, LLC, the Ohio Creek Formation would qualify as an exempt aquifer under this Commission’s Rule No. 324B.a. in that: 1.The formation being considered for disposal of produce water is the Ohio Creek Formation which is at an approximate depth of 3,033-3,245 feet in the subject well with an approximate porosity of 16% to 17%. There is an upper and lower member of the formation consisting of a series of interbedded sandstones which should be capable of receiving the anticipated volumes of water to be injected. There are no known underground sources of drinking water that are currently in use within one (1) mile of the location of the well. The nearest constructed water well is about one (1) mile away, permit # 76951-F, locatedin the SESE Sec 36 T2N, R97W. The well is a gravel pit, with record of water at 14 feet. 2. The total dissolved solids of water sampled from the Ohio Creek formation in the subject well was determined to be 3100 milligrams per liter as determined by analysis run on October 29, 2013. Since the total dissolved solids content of this water is more than three thousand (3,000) and less than ten thousand (10,000) milligrams per liter, the aquifer must be designated by the Director as an exempt aquifer as provided for in Rule 324B. It is not reasonable to expect the water from the aquifer to supply a public water system or to be used for domestic purposes in an individual well forthe following reasons: The aquifer does not currently serve as a source of drinking water, and, it cannot now, and will not in the future, serve as a source of drinking water because the aquifer is located at depth in excess of 3,033 feet, at a remote location with an elevation in excess of 5,800 feet and there are surface water supplies of better quality in the vicinity which would be more economical for use as a source of drinking water. Such exemptions apply only to the Ohio Creek Formation in the entire SE 1/4 and the E 1/2 of the SW 1/4 of Section 25, and the NE 1/4 of the NW 1/4 and the N 1/2 of the NE 1/4 of Section 36, Township 2 North, Range 97 West, 6th P.M., Rio Blanco County, Colorado. This notice proposing an aquifer exemption is being published in accordance with Commission Rule 324B.b. Any person who would be directly and adversely affected or aggrieved by the designation may request the Commission to hold a hearing thereon. If, within thirty (30) days after publication of this notice, the Commission does not receive a hearing request which indicates there is a significant degree of public interest in a hearing on the designation of the aquifer and the disposal well permit is approved, the Ohio Creek Formation in the limited area described herein shall be considered exempt. If, within thirty (30) days after publication of this notice the Commission receives a hearing request which indicates there is a significant degree of public interest in a hearing on the designation of the aquifer or portion thereof as exempted is shown, the Commission shall hold such a hearing as soon as practicable and shall make a final determination regarding the designation.
