ORDINANCE NO. 03-2013 THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO AN ORDINANCE OF THE TOWN OF MEEKER APPROVING THE TRANSFER AND CONVEYANCE OF PROPERTY KNOWN AS THE “OLD ELEMENTARY SCHOOL”, OR “MAIN STREET BUILDING” TO THE BOARD OF COUNTY COMMISSIONERS OF RIO BLANCO COUNTY, COLORADO AND AUTHORIZING THE TOWN MAYOR TO EXECUTE ON BEHALF OF THE TOWN, THE DOCUMENT(S) REQUIRED TO COMPLETE THE TRANSFER WHEREAS, the Town of Meeker (Town) currently owns property located in the Town of Meeker known as the “Old Meeker Elementary School”, or “Main Street Building ” (Property) and more specifically described by the legal description set forth on Exhibit A attached hereto; and WHEREAS, the Property is not currently used or held by the Town for any governmental purpose and will not be used for any governmental purpose in the reasonably foreseeable future; and WHEREAS, pursuant to Section 31-15-713(1)(b) C.R.S., the Town has the authority to sell and dispose of by ordinance real estate not used or held for any governmental purpose upon such terms and conditions as the Town may determine at a regular or special meeting; and WHEREAS, the Board of County Commissioners of Rio Blanco County, Colorado (Board) has proposed utilizing the property for construction of a much needed justice center which will house a new County Jail, expanded Court facilities and County Law Enforcement facilities; and WHEREAS, the Board of Trustees of the Town has determined the County’s proposal to accept the Property in its current condition and assume all obligations related to the Property constitutes substantial consideration for the conveyance of the Property to the County; and WHEREAS, The Board of Trustees of the Town conducted a public hearing on this request on May 21, 2013 and following this public hearing, the Board of Trustees recommended by a 4-0 vote to transfer and convey ownership of the Property to the Rio Blanco County Board of County Commissioners; and WHEREAS, the Board of Trustees of the Town finds, determines, and declares that this Ordinance is necessary and proper to provide for the safety, preserve the health, promote the prosperity, and improve the order, comfort, welfare and convenience of the Town of Meeker and the inhabitants thereof; and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER AS FOLLOWS: 1.The transfer of the Old Elementary School (Property) as described on Exhibit A to the Board of County Commissioners of Rio Blanco County, Colorado, (Board), is hereby approved subject to the condition that the Board by the adoption of a Resolution agrees to assume all responsibility and liability for the Property and accepts the Property “as is, where is and with all faults.” 2.Upon receipt of a copy of said Resolution, Mayor Mandy Etheridge is authorized to execute a deed of conveyance transferring title of the Property to the Board of County Commissioners. 3.In the event the Board fails to adopt said Resolution on or before thirty (30) days from the date of adoption of this Ordinance, the approval and authorization set forth in this Ordinance shall terminate and be of no further effect. 4.The Property is free and clear of all encumbrances, and/or obligations related to its future use. 5.Town Staff is directed to provide to the Board all information, documentation, and reports in the possession of the Staff related to the Property. 6.If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. On April 4, the Meeker Lions Club installed new shelving units for the New Eden Pregnancy Care Center. New Eden asked the Lion’s Club to help them come up with more storage for items within the building, and the Lion’s Club raised money to purchase shelves. OPAL MUNGER PHOTO
