MATERIAL The material shall be hot poured rubberized crack sealer (Deery American 974 The material shall conform to the requirements of ASTM D-3407 for hot poured elastic type sealant. The sealant shall be delivered in the manufacturers sealed containers. Each container shall be legibly marked with the manufacturer name and trade name of the material. Materials from different manufacturers other than stated above shall not be allowed. The supplier shall issue a certificate of compliance stating that the material meets the requirements of this project. Construction Requirements Equipment: Heating pots for hot poured sealant shall be an indirect double boiler type using oil heat transfer medium. The heating pot shall be capable of controlling the temperature of the sealant within the manufacturers recommended application range. A thermometer calibrated within +/-5 degrees Fahrenheit for range of 200 to 500 degrees Fahrenheit shall be provided. The heating pot shall be capable of constantly agitating the material. All cracks larger than 1/8 inch and less than one inch in width are to be sealed. Weather Limitations Sealant shall not be placed when the weather is foggy, raining, or when the surface to be sealed is damp or wet. Preparation Immediately prior to the placement of the sealant, the cracks shall be blown clean of dirt, debris, or foreign matter to a depth of at least twice the width of the crack but to a depth of no greater than the pavement thickness. Application The sealant shall be heated according to the manufacturer recommendations, applied at the manufacturer temperature and installed flush with the pavement surface. Immediately after the crack is filled, excess material shall be leveled off of the surface by a squeegee, a shoe attached to the applicator wand, or other suitable means. The squeegeed material shall be centered in the crack and shall not exceed 3 inches in width nor 1/16 inch above the surface of asphalt. ORDINANCE NO. 06-2014 THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO AN ORDINANCE OF THE TOWN OF MEEKER APPROVING THE VACATION OF THAT PORTION OF FIFTH STREET LOCATED BETWEEN MAIN STREET AND PARK AVENUE WHEREAS, on June 4, 2013, the Town of Meeker (Town) passed Ordinance No. 03-2013 wherein the Town transferred property known as the “Old Meeker Elementary School” or “Main Street Building” (Property) to Rio Blanco County (County) for use of the future County Justice Center, and subsequently deeded the Property to the County; and WHEREAS, a portion of Fifth Street located between Main Street and Park Avenue intersects the Property, and constitutes the roadway between the existing County Courthouse and the future Justice Center building and the County owns the property on both sides of this portion of Fifth Street; and WHEREAS, the County has requested that the Town vacate this portion of Fifth Street so that the County can use this area in furtherance of the Justice Center and community events; and WHEREAS, as part of the Land Use Code process to accomplish the vacating of the roadway, the County has submitted a Vacation Plat and legal description, attached hereto as Exhibit A (available at Town Hall); and WHEREAS, pursuant to Section 43-2-203 C.R.S., the Town may vacate a municipal street by way of an ordinance approved by the Town; and WHEREAS, on March 17, 2013, the Town of Meeker Planning Commission conducted a public hearing on the request to vacate Fifth Street, wherein the Planning Commission heard and considered evidence and testimony as offered by the Town Staff, Applicant, and members of the public, and recommended approval of the request to vacate that portion of Fifth Street as described on the attached Exhibit A (available at Town Hall); and WHEREAS, the Planning Commission also recommended that Meeker Municipal Code Chapter 12.12.050, Commercial Streets, Section (3), be amended to remove 5th Street from the description; and WHEREAS, on March 18, 2014, the Board of Trustees conducted a public hearing on the request to vacate Fifth Street, wherein the Board of Trustees heard and considered evidence and testimony as offered by the Town Staff, Applicant, and members of the public, and following this public hearing, the Board of Trustees recommended in favor of vacating that portion of Fifth Street as described on the attached Exhibit A (available at Town Hall); and WHEREAS, the Board of Trustees finds and determines: a) this Ordinance is reasonable and consistent with the Town Code and State Statutes and b) this Ordinance is reasonably necessary to promote the legitimate public purposes of the health, safety and welfare of the Town of Meeker and the inhabitants thereof. NOW, THEREFORE, BE IT ORDAINED BY THEBOARD OF TRUSTEES OF THE TOWN OF MEEKER AS FOLLOWS: 1. That portion of Fifth Street located between Main Street and Park Avenue, as described on Exhibit A (available at Town Hall), is hereby vacated. 2. Meeker Municipal Code Chapter12.12.050, Commercial Streets, Section (3) be amended to read as follows: “(3) Market Street to Main Street.” 3. Following the effective date of this Ordinance No. 06-2014, the attached Vacation Plat and Legal Description shall be recorded in the Rio Blanco County Clerk and Recorder’s office to serve as a record of this vacation. 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. EFFECTIVE DATE This Ordinance shall take effect thirty days after its publication as provided in Section 30-15-405 C.R.S.
