ORDINANCE NO. 123 (Series of 2009) – AN ORDINANCE REGULATING TRAFFIC IN THE TOWN OF DINOSAUR COLORADO, BY ADOPTING BY REFERENCE THE 2009 EDITION OF THE “MODEL TRAFFIC CODE FOR COLORADO”, AND REPEALING THE 2003 EDITIONTHEREOF. WHEREAS, the Town of Dinosaur previously has adopted by reference the Model Traffic Code for Colorado Municipalities, 2003 Edition; and WHEREAS, the Colorado Department of Transportation has revised the Model Traffic Code and promulgated the “Model Traffic Code for Colorado, 2009 Edition;” and WHEREAS, the Town Council is authorized to adopt by reference the Model Traffic Code, 2009 Edition, as provided by Sections 31-16-201, et seq., C.R.S.; and WHEREAS, the Town Council finds and determines that the adoption of the 2009 Model Traffic Code is in the best interest of the public health, safety and welfare of the citizens of Dinosaur. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF DINOSAUR, COLORADO: Section 1. Adoption. Pursuant to Parts 1 and 2 of Article 16 of Title 31, C.R.S., as amended, there is hereby adopted by reference Articles 1 and 11, inclusive, of the 2009 edition of the “Model Traffic Code for Colorado,” and appendices thereto, promulgated and published as such by the Colorado Department of Transportation, Safety and Traffic Engineering Branch, 4201 E. Arkansas Avenue, EP 700., Denver Colorado 80222. The subject matter of the Model Traffic Code relates primarily to comprehensive traffic and vehicle control regulations for the Town of Dinosaur. The purpose of this Ordinance and the Code adopted herein is to provide a system of uniform traffic regulations consistent with State law, and generally conforming to similar regulations throughout the State and the nation. Section 2. Amendments. (A) Section 17-1, Traffic Offenses Classified-Schedule of Fines, is hereby modified by the addition of a new subsection(5) to read as follows: 17-1 Traffic Offenses Classified-Schedule of Fines (5) If a person receives a Penalty Assessment notice for a violation under this Section 17-1 and such person pays the fine and any applicable surcharge for the violation on or before the date the payment is due, the points assessed for the violation are reduced as follows: i. For a violation having as assessment of 3 or more points under Section 42-2-127(5)C.R.S., as amended, the points are reduced by 2 points; ii. For a violation having an assessment of 2 points under Section 42-2-127(5) C.R.S., as amended, the points are reduced by 1 point. (B) Section 1101(2) of the Model Traffic Code for Colorado Municipalities, 2009 Edition, adopted by reference herein, is amended to read as follows: (2) Except when a special hazard exists that requires a lower speed, the following speed shall be lawful: (a) Twenty-five (25) miles per hour on all Town Streets, unless otherwise posted. (b) Ten (10) miles per hour on all public alleys. (c) Forty (40) miles per hour on open mountain highways. (d) Forty-five (45) miles per hour for all vehicles in the business of transporting trash, or higher speeds are posted, when said vehicle is loaded as an exempted vehicle pursuant to Section 507(3). (e) Fifty-five (55) miles per hour on other open highways which are not on the interstate system, as defined in Section 43-2-101(2), C.R.S. (f) Seventy-five (75) miles per hour on surface, four lane highways which are on the interstate system, as defined in Section 43-2-105(2), C.R.S., where authorized by a majority of the members of the Transportation Commission and such speed has been so designated by official traffic control devices. Section 3. Application. This Ordinance shall apply to every street, alley, sidewalk area, driveway, park and to every public way or public place or public parking area, either within or outside the corporate limits of this municipality, the use of which this municipality has jurisdiction and authority to regulate. The provisions of Section 1211, 1401, 1402, and 1413 of the adopted Model Traffic Code, respectively concerning limitations on backing, reckless driving, careless driving and eluding a police officer shall apply not only to public places and ways but also throughout this municipality. Section 4. Interpretation. This Ordinance shall be so interpreted and construed as to effectuate its general purpose to conform with the State’s uniform system for the regulation of vehicles and traffic. Article and section headings of this Ordinance and the adopted Model Traffic Code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or extent of the provisions of any article or section thereof. Section 5. Copies on File and Available for Sale. At least one copy of the Model Traffic Code for Colorado, 2009 Edition together with one copy of the Ordinance shall be kept on file in the office of the Town Clerk, or in the office of the Police Chief as provided by 31-16-206,C.R.S. The Clerk shall at all times maintain a reasonable supply of copies of the Model Traffic Code for Colorado, 2009 Edition available for purchase by the public at a moderate price. Section 6. Penalties. Any person who violates any of the provisions contained in the Model Traffic Code commits a non-criminal municipal offense punishable by a fine of up to three hundred dollars ($300.00) except any of the following violations which shall constitute a criminal municipal offense punishable by a fine of up to three hundred dollars ($300.00), imprisonment for a period not to exceed ninety (90) days, or by both such fine and imprisonment: A. MTC 1101 (1) Speeding and (2) If the alleged violator is accused of exceeding the prima facie speed limit by more than 19 mph; B. MTC 1101 (3) Special Hazards (if the alleged violation has caused, or contributed to the cause of , an accident resulting in appreciable damage to property of another or an injury or the death to any person); C. MTC 1105 Speed Contest; D. MTC 1401 Reckless Driving; E. MTC 1402 Careless Driving (if the violation has caused, or contributed to the cause of, an accident resulting in appreciable damage to property of another or an injury or death to any person); F. MTC 1413 Eluding or Attempting to Elude a Police Officer; G. MTC 1903 Stopping for School Buses; and H. Any other offense contained in the Model Traffic Code resulting in an accident causing personal injury or substantial property damage. Section 7. Severability. If any part or parts of this Ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Town Council hereby declares that it would have passed this Ordinance and each part or parts thereof, irrespective of the fact that any one part or parts might be declared invalid. Section 8. Repeal. Any existing or parts of ordinances covering the same matters as embraced in this Ordinance, including adoption of the 2003 Edition of the Model Traffic Code, are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this Ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the effective date of this Ordinance.
