Notification of meeting for the Rangely Town Council, Board of Trustees The Town of Rangely Town Council meetings are held on the 2nd and 4th Tuesday of every month starting at 7:00 p.m. in the Court Room at 209 E. NOTICE OF 45 DAY PUBLIC COMMENT PERIOD – The public is advised to take notice of a 45 day public comment period concerning use of $357,000 of Federal funds in Rio Blanco County reserved for expenditure in accordance with Title III of the Secure Rural Schools and Community Self-Determination Act of 2000. More specifically, these funds are proposed to be used to update the Community Wildfire Protection Plan of 2006 in regard to notification and evacuation by developing the emergency 9-1-1 system and database to include mapping of county roads, naming roads, locating structures, and improvements of the mapping system. In some instances, address corrections could be required. This work shall take place in fire protection districts that include, abut, or share fire shed with the National Forest. Ordinance No. 5, Series 2011 – AN ORDINANCE PROVIDING FOR THE MEEKER TOWN BOARD OF TRUSTEE’S DETERMINATION CONCERNING WHITE RIVER ELECTRIC ASSOCIATION’S PROPOSED RELOCATION OF ITS 69-KV TRANSMISSION POWER LINES IN UTE PARK AND THE PROPOSAL’S COMPATIBILITY WITH THE UTE PARK-MASTER PLAN AND PROVIDING FOR THE REVISION OF THE UTE PARK-MASTER PLAN MAPS AND THE REVISION OF THE TEXT OF THE SECTION ENTITLED “OVERHEAD POWER LINES”. WHEREAS, the Town of Meeker, the “Town”, owns Ute Park; and, WHEREAS, subsequent to the Town’s acquisition of Ute Park, the Town Board of Trustees, the “Town Board”, undertook a development study of said parcel of land, now known as the Ute Park-Master Plan, the “Master Plan”; and, WHEREAS, in addition to providing open space and a park setting, Ute Park has been the venue for various community events and will continue to be used for such purposes and it is the Town Board’s intent to broaden the public’s use of Ute Park, consistent with the Master Plan; and, WHEREAS, at a Town Board workshop on August 22, 2011, as a part of the advertised meeting agenda, the Town Board had a presentation from a representative of White River Electric Association (WREA) concerning the proposed relocation of its 69-KV Transmission Power Line currently located in Ute Park and WREA’s interest in having the Town make a timely determination concerning said relocation project in order for WREA to undertake the necessary steps to more forward with the project’s engineering phase; upon the WHEREAS, the Town Board determined it would be necessary and in the best interest of the Town and its citizens to hold a public hearing to consider said proposal and its compatibility with the Master Plan; and, WHEREAS, a public hearing was held on September 6, 2011, at a regular Town Board meeting at Town Hall, 345 Market Street, Meeker, Colorado, to which hearing public notice was given by publication in the Rio Blanco Herald Times newspaper on September 1, 2011; and, WHEREAS, the public was, at such public hearing, given the opportunity to voice its opinion regarding said proposal; and, WHEREAS, a WREA representative presented it proposal concerning the relocation of its 69-KV Transmission Power Line, located in Ute Park, and the purposes of the proposed project and presented a map depicting the existing 69-KV Transmissions Power Line and the proposed relocation of said Transmission Power Line; and, WHEREAS, the Town Administrator informed the Town Board that WREA’s 69-KV Transmission Power Line has been a part of the White River Electric Association’s power system for many years and had been installed in its current location on the real property, now known as Ute Park, prior to the time of its acquisition by the Town of Meeker; furthermore, the Master Plan acknowledges the existing 69-KV Transmissions Line and notes that said Transmission Line cannot be buried; the Master Plan recognizes that the design of Ute Park’s site development has accommodated these, and other, existing utility lines; and, furthermore, stated that the area proposed for the relocation of one of the Transmission Lines may impact Ute Park less than the Transmission Line’s current location, which is along the length of Ute Park (in a east/west direction) adjacent to Main Street; and, WHEREAS, the Town Administrator and the Town Attorney informed the Town Board that it would be necessary for the Town to negotiate appropriate easement agreements with WREA to permit its Relocation project to move forward and that the necessary easements should be finalized, approved by the Town Board, and filed for recording in the Office of the Clerk and Recorder of Rio Blanco County prior to WREA’s commencement of construction of its relocation project in Ute Park. WHEREAS, on the basis of the evidence produced at said public hearing, the Town Board made the following determinations of fact: 1) the public hearing concerning the proposal, as described herein above, has met the requirements of the laws of the State of Colorado and the ordinances of the Town; and, 2) the hearing before the Board was complete and that all persons had an opportunity to speak; and, 3) the proposed project on the designated portion of Ute Park would result in mitigating the effects of the Transmission Line as it currently exist in Ute Park; is not incompatible with the Master Plan; and the vacation of the existing Transmission Line’s easement would be in the best interest of the Town in order to remove a burden placed upon the Ute Park property, which has the potential of inhibiting future development within this area of Ute Park; and is in the best interest of the public health, safety, and welfare of the Town, its citizens, and the persons using Ute Park. FURTHERMORE, BE IT ORDAINED that the Master Plan text in the section entitled “Overhead Power Lines” be revised and the various Ute Park Plan maps, be revised by depicting on the maps or by written notation on the maps acknowledging the relocation of the 69-KV Transmission Power Line, upon WREA’S completion of said Relocation project, and the vacation of WREA’s existing 69-KV Transmission Power Line easement, all consistent with the provisions of this Ordinance. FURTHERMORE, BE IT ORDAINED that prior to the Town permitting WREA, it contractors, representatives, or agents to commencement construction for the relocation of its 69-KV Transmission Power Line in Ute Park, any and all necessary Town easement agreements permitting WREA in, on, over and across Ute Park for the construction and operation of said Transmission Line shall have been approved by the Town Board by a Board resolution, and, thereafter, said resolution shall be filed for recording in the Office of the Clerk and Recorder of Rio Blanco County. Any and all easement agreements shall be in such form, acceptable to the Town Attorney and the Town Administrator, so at to protect the general health, safety and welfare, including the goals, objectives and overall development plan as set forth in the Ute Park-Master Plan. FURTHERMORE, BE IT ORDAINED THAT the Town Board and WREA shall mutually agree upon the vacation by WREA of any and all easements for its existing 69-KV Transmission Power Line in Ute Park following the completion of said Relocation project. FURTHERMORE, BE IT ORDAINED that the Town Administrator and the Public Works Department Superintendent are hereby authorized to take any and all action, as deemed necessary, in the best interests of the Town, to coordinate with WREA during said Relocation project. Section II: It is the intention of the Town Board of Trustees of the Town of Meeker that each separate provision of this ordinance shall be deemed independent of all other provisions therein.
