Notification of meeting for the Rangely Town Council, Board of Trustees The Town of Rangely Town Council meetings are held on the 2nd and 4th Tuesday of every month starting at 7:00 p.m. in the Court Room at 209 E Main, Rangely, CO 81648. Town of Meeker Bid Request – The Town of Meeker is asking for bidders to do some repair and replacement of sheetrock at Town Hall. The sheetrock repair is located in the Boiler Room and the Elevator Shaft. The outside repair is replacing some soffit and fascia on the underside of the roof. Ordinance No. 3, Series 2011: AN ORDINANCE OF THE TOWN OF MEEKER PROHIBITING THE ESTABLISHMENT OR OPERATION OF MEDICAL MARIJUANA CENTERS, MEDICAL MARIJUANA OPTIONAL PREMISES CULTIVATION OPERATIONS, AND MEDICAL MARIJUANA-INFUSED PRODUCTS MANUFACTURERS AND THE PROHIBITION AND LIMITATION ON THE CULTIVATION OR SALE OF MEDICAL MARIJUANA AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF AND PROVIDING FOR AN AFFIRMATIVE DEFENSE. WHEREAS, the Town Board of Trustees of Meeker, the “Town Board”, previously adopted Ordinance No. 8, Series 2009, imposing a one year temporary moratorium on the submission, acceptance, processing, and approval of any application for a Town permit or license related to the operation of a business that sells medical marijuana, pursuant to the authority granted by Article XVIII, section 14 of the Colorado Constitution, in order to allow the Town staff, in conjunction with the Town Attorney, to investigate and evaluate the regulatory authority of the Town concerning such businesses within the Town; and, WHEREAS, during the pendency of Ordinance No. 8, Series 2009, the Colorado Legislature adopted legislation which added Article 43.3 to Title 12 to the Colorado Revised Statutes, known as the Colorado Medical Marijuana Code; and, WHEREAS, C.R.S. §12-43.3-202(1)(b)(I) provided for a municipality, that had adopted a temporary moratorium regarding the subject matter of Article 43.3, be specifically authorized to extend its moratorium…”, which the Town Board did by the adoption of Ordinance No. 6, 2010, thereby, extending the temporary moratorium until July 1, 2011, in order to allow the Town Board and the Town staff additional time to investigate the Town’s ability to regulate such medical marijuana operations, as provided by the Colorado Medical Marijuana Code; and, WHEREAS, C.R.S. §12-43.3-103(2)(a), provides that a municipality may adopt and enforce an ordinance prohibiting the cultivation and sale of medical marijuana and C.R.S. §12-43.3-106, specifically, authorizes a majority of the members of the governing board for the municipality vote to prohibit the operation of medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers’ licenses; and, WHEREAS, C.R.S. §12-43.3-310, specifically, authorizes a municipality “to prohibit the operation of medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers’ licenses…based on local government zoning, health, safety, and public welfare laws for the distribution of medical marijuana that are more restrictive than this article”; and, WHEREAS, the Town Board has carefully considered the provisions of the Colorado Medical Marijuana Code; Article XVIII, §14 of the Colorado Constitution; and the impact of medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers on the health, safety and welfare of the Town and the inhabitants thereof, and has determined as an exercise of its local regulatory and land use authority that such medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers and the cultivation or sale of medical marijuana shall not be located within the corporate limits of the Town; and, WHEREAS, the Town Board recognizes the protections afforded by Article XVIII, §14 of the Colorado Constitution, and desires to affirm the ability of patients and primary caregivers to otherwise be afforded, the protections of Article XVIII, section 14 of the Colorado Constitution and C.R.S. §25-1.5-106, as the same may be amended from time to time; and, WHEREAS, a public hearing was held on March 15, 2011 before the Town Board at its regular meeting at the Meeker Town Hall, 345 Market Street, to which public hearing, public notice was duly given in the Rio Blanco Herald Times newspaper; and, WHEREAS, the Town Board has been advised by the Town staff that, to date, the Town has not received any inquiries or requests for licensure from any persons interested in opening or operating businesses related to medical marijuana centers, optional premises cultivation operations, or medical marijuana-infused products manufactures, or related to the cultivation or sale of medical marijuana, therefore, no person will be unduly prejudiced by the proposed regulations or prohibitions provided for in this ordinance; and, WHEREAS, at the public hearing, the Town Board heard and considered the statements of the Town staff concerning the prohibition of the operation of medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers and the cultivation or sale of medical marijuana; and, WHEREAS, the public, at such hearing, was given the opportunity to voice its opinion regarding the proposed regulations and prohibitions, described herein above; and, WHEREAS, the Town Board on the basis of the evidence produced at the public hearing has made the following determination and findings of fact: 1. The proposed regulations have met the requirements of the laws of the State of Colorado and the ordinances of the Town; and, 2. That the hearing before the Town Board was complete and all persons had an opportunity to speak; and, 3. That it is in the best interest of the citizens of the Town to amend the Meeker Municipal Code on the basis of the reasons set forth above, pursuant to the authority of Colorado Medical Marijuana Code, C.R.S. §12-43.3-101, et seq.; the Local Government Land Use Control and Enabling Act of 1974 in Article 20 of Title 29 of the Colorado Revised Statutes; Part 1 of Article 15 of Title 31 of the Colorado Revised Statutes (concerning municipal bodies politic powers); Part 3 of Article 23 of Title 31 of the Colorado Revised Statutes (concerning municipal zoning powers); C.R.S. §31-15-103 (concerning municipal powers for the making of ordinances); C.R.S. §31-15-401 (concerning municipal police powers); and C.R.S. §31-15-501 (concerning municipal powers to regulate business). A new Chapter 8.29 is hereby added to the Meeker Municipal Code to read in full as follows: Chapter 8.29 Medical Marijuana Section 8.29.101 Purpose and Applicable A. Although the possession and use of marijuana is and remains unlawful under Federal law, Article XVIII, §14 of the Colorado Constitution provides an exception to prosecution under state criminal laws when marijuana is possessed and used for medicinal purposes by a patient who has been diagnosed with a debilitating medical condition, and by the patient’s primary caregiver. The Colorado Constitution does not, however, contain any provision for the lawful sale or distribution of marijuana to patients. The Colorado Medical Marijuana Code clarifies Colorado law regarding the scope and extent of Article XVIII, §14 of the Colorado Constitution, and at the same time authorizes a regulatory scheme for the retail sale, distribution, cultivation and dispensing of medical marijuana known as a “Medical Marijuana Center,” and further authorizes licensing mechanisms known as an “Optional Premises Cultivation Operation” and a “Medical Marijuana-Infused Products Manufacturers’ License. C.R.S. §12-43.3-106, specifically, authorizes the governing body of a municipality to “vote to prohibit the operation of medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers’ licenses”. The purpose of this Chapter is to prohibit, within the Town of Meeker, such medical marijuana facilities as provided for by the Colorado Medical Marijuana Code. B. This Chapter is necessary to protect and is enacted in furtherance of the public health, safety and welfare of the Town and its inhabitants. C. This Chapter is intended to apply and shall apply to any and all property, businesses, conduct, activity or business entities operating within the Town of Meeker, whether stationary, mobile, or virtual. D. This Chapter and the prohibitions herein are intended to apply and shall apply in any and all zoning districts within the Town of Meeker. Section 8.29.102 Definitions. As defined in this chapter, unless the context otherwise requires, the following terms, phrases, words and their derivation shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number; and every word importing the masculine gender only may extend to and be applied to females and things as well as males and every word importing the neuter gender only may extend to and be applied to natural persons as well as things. The word “shall” is always mandatory and not merely directory: “Amendment 20” means Article XVIII, §14 of the Colorado Constitution, adopted on November 7, 2000. “Colorado Medical Marijuana Code” means Part 1 of Article 43.3 of Title 12 of the Colorado Revised Statutes, C.R.S. §12-43.3-101, et seq. “Debilitating medical condition” means a condition described in Article XVIII, §14 (1)(a) of the Colorado Constitution. “Medical marijuana” means marijuana that is grown and sold pursuant to the provisions of the Colorado Medical Marijuana Code and for a purpose authorized by Article XVIII, §14 of the Colorado Constitution. “Medical marijuana center” means a person licensed pursuant to the Colorado Medical Marijuana Code to operate a business as described in C.R.S. § 12-43.3-402 that sells medical marijuana to registered patients or primary caregivers as defined in Article XVIII, §14 of the Colorado Constitution, but is not a primary caregiver, and which a municipality is authorized to prohibit as a matter of law. “Medical marijuana-infused product” means a product infused with medical marijuana that is intended for use or consumption other than by smoking, including but not limited to edible products, ointments, and tinctures. “Medical marijuana-infused products manufacturer” means a person licensed pursuant to the Colorado Medical Marijuana Code to operate a business manufacturing medical marijuana-infused products, and which a municipality is authorized to prohibit as a matter of law. “Medical use” means the acquisition, possession, production, use, or transportation of marijuana or paraphernalia related to the administration of such marijuana to address the symptoms or effects of a patient’s debilitating medical condition, which may be authorized only after a diagnosis of the patient’s debilitating medical condition by a physician or physicians, as provided Amendment 20. “Optional premises cultivation operation” means a person licensed pursuant to the Colorado Medical Marijuana Code to grow and cultivate medical marijuana for a purpose authorized by Article XVIII, §14 of the Colorado Constitution, and which a municipality is authorized to prohibit as a matter of law. “Patient” means a (natural) person who has a debilitating medical condition. “Person” means a natural person, partnership, association, company, corporation, limited liability company, or organization, or a manager, agent, owner, director, servant, officer, or employee thereof. “Physician” means a doctor of medicine who maintains, in good standing, a license to practice medicine issued by the state of Colorado. “Primary caregiver” means a natural person, other than the patient and the patient’s physician, who is eighteen years of age or older and has significant responsibility for managing the well-being of a patient who has a debilitating medical condition. Except, as provided by C.R.S. §25-1.5-106(3)(b)(I), the act of supplying medical marijuana or marijuana paraphernalia, by itself, is insufficient to constitute “significant responsibility for managing the well-being of a patient”, for purposes of determining a “primary caregiver”. Section 8.29.103 Medical Marijuana Centers, Optional Premises Cultivation Operations, and Medical Marijuana-Infused Products Manufacturer – Prohibited Uses. A. The operation of medical marijuana centers, optional premises cultivation operations or medical marijuana-infused product manufacturer or any sale facility, business or operation related thereto within the Town limits, which may be authorized under the Colorado Medical Marijuana Code, are hereby prohibited and unlawful. B. It shall be unlawful and a violation under this Chapter for any person to establish, operate, cause to be operated, or permit to be operated within the Town’s limits, and within any area annexed into the Town after March 15, 2011, a facility, business or any other operation under the Colorado Medical Marijuana Code as a medical marijuana center, optional premises cultivation operation, or as a medical marijuana-infused products manufacturer or any sale facility, business or operation related thereto. Section 8.29.104 Cultivation and Sale of Medical Marijuana – Prohibited A. As authorized by C.R.S. §12-43.3-103(2)(a), no person shall cultivate medical marijuana within the Town’s limits, unless such person does so as a registered patient or licensed primary caregiver, pursuant to and in accordance with C.R.S. §25-1.5-106. B. As authorized by C.R.S. §12-43.3-103(2)(a), no person shall sell medical marijuana within the Town’s limits, unless such person does so as a licensed primary caregiver, pursuant to and as provided by C.R.S. §25-1.5-106. Section 8.29.105 Patients and Primary Caregivers – Affirmative Defense – Limitation. A. Nothing in this Chapter shall be construed to prohibit, regulate, or otherwise impair the medical use of marijuana by a registered patient or the provision of medical marijuana by a licensed primary caregiver for his or her patients, provided that any such patient or primary caregiver is doing so in accordance with all applicable provisions of Amendment 20; the Colorado Medical Marijuana Code, as amended: C.R.S. §25-1.5-106, as amended; and the Town’s ordinances, and in accordance with any applicable rules and regulations promulgated under state law. B. Notwithstanding the provisions of this Chapter, it shall not be unlawful and it shall be an affirmative defense to criminal prosecution under the provisions of the Meeker Municipal Code, including, but, not limited to M.M.C. Title 9, the Offense Ordinance of the Town of Meeker, for a medical marijuana patient or primary caregiver to possess, use, or obtain medical marijuana, when such medical marijuana patient or primary caregiver is fully and currently compliant with all applicable state laws, regulations, and registration or licensing requirements concerning medical marijuana, provided that such medical use of marijuana is not in plain view of, or in a place open, to the general public; does not occur on property owned or possessed by the Town; or possess medical marijuana or otherwise engage in the use of medical marijuana in or on the grounds of a school or in a school bus, or as otherwise provided by Amendment 20 or C.R.S. §25-1.5-106. C. Notwithstanding the foregoing provisions, no person, including a patient or a primary caregiver, pursuant to or as provided by Amendment 20 or C.R.S. §25-1.5-106, shall be entitled to the protection of this section for his or her acquisition, possession, manufacture, production, use, sale, distribution, dispensing, or transportation of marijuana for any use other than medical use. Section 8.29.106 Penalty. A. A violation of any provision of this Chapter 8.29 shall constitute an ordinance offense punishable by a fine of not more than one thousand dollars ($1000.00) or imprisonment for a term not exceeding one (1) year, or both such fine and imprisonment. A person committing any such offense shall be guilty of a separate offense for each and every day, or any portion thereof, during which the offense is committed or continued to be permitted by such person, and shall be punished accordingly. B. Violations of this ordinance are declared to be a nuisance and the Town is specifically authorized to seek an injunction, abatement, restitution, or any other remedy necessary to prevent, enjoin, abate, or remove the violation. C. Any remedies provided for herein shall be cumulative and not exclusive, and shall be in addition to any other remedies provided by law or in equity. Section II. The Town Board hereby finds, determines, and declares that this ordinance is necessary and proper to provide for the safety, preserve the health, promote the prosperity, and improve the order, comfort and convenience of the Town and the inhabitants thereof. The recitals of this ordinance are hereby adopted by the Town Board as additional findings. Section III. Existing ordinances or parts or ordinances inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment or any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Ordinance No. 8, Series 2009 and Ordinance No. 6, Series 2010 are repealed hereby upon the taking effect of this ordinance. Section IV. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Town of Meeker hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. Section V. The Mayor and Town Clerk are hereby directed to execute this ordinance. Section VI. The codifier of the Meeker Municipal Code is hereby authorized to make such numerical and formatting changes as may be necessary to incorporate the provisions of this ordinance within the Meeker Municipal Code. The Town Clerk is authorized to correct, or approve the correction by the codifier, of any typographical error in the enacted regulations, provided that such correction shall not substantively change any provision of the regulations adopted in this ordinance. Such corrections may include spelling, reference, citation, enumeration, and grammatical errors. Section VII. In order to implement the Town’s authority pursuant to the Colorado Medical Marijuana Code to prohibit medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturer or prohibit the cultivation or sale of medical marijuana for the protection of the public health, safety and welfare of the Town, as soon as possible following the adoption of this ordinance by the Town Board, an emergency is declared to exist, and this ordinance is declared to be necessary for the immediate preservation of the public peace, health and safety. Wherefore, this ordinance shall be in full force and effect upon adoption of this ordinance on March 15, 2011, upon the adoption of this ordinance by an affirmative vote of three-fourths (3/4) of the members of the Town Board of Trustees. The proposed regulations have met the requirements of the laws of the State of Colorado and the ordinances of the Town; and, 2. That the hearing before the Town Board was complete and all persons had an opportunity to speak; and, 3. A new Chapter 8.29 is hereby added to the Meeker Municipal Code to read in full as follows: Chapter 8.29 Medical Marijuana Section 8.29.101 Purpose and Applicable A. Although the possession and use of marijuana is and remains unlawful under Federal law, Article XVIII, §14 of the Colorado Constitution provides an exception to prosecution under state criminal laws when marijuana is possessed and used for medicinal purposes by a patient who has been diagnosed with a debilitating medical condition, and by the patient’s primary caregiver. The Colorado Constitution does not, however, contain any provision for the lawful sale or distribution of marijuana to patients. The Colorado Medical Marijuana Code clarifies Colorado law regarding the scope and extent of Article XVIII, §14 of the Colorado Constitution, and at the same time authorizes a regulatory scheme for the retail sale, distribution, cultivation and dispensing of medical marijuana known as a “Medical Marijuana Center,” and further authorizes licensing mechanisms known as an “Optional Premises Cultivation Operation” and a “Medical Marijuana-Infused Products Manufacturers’ License. C.R.S. §12-43.3-106, specifically, authorizes the governing body of a municipality to “vote to prohibit the operation of medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers’ licenses”. The purpose of this Chapter is to prohibit, within the Town of Meeker, such medical marijuana facilities as provided for by the Colorado Medical Marijuana Code. B. This Chapter is necessary to protect and is enacted in furtherance of the public health, safety and welfare of the Town and its inhabitants. C. This Chapter is intended to apply and shall apply to any and all property, businesses, conduct, activity or business entities operating within the Town of Meeker, whether stationary, mobile, or virtual. D. This Chapter and the prohibitions herein are intended to apply and shall apply in any and all zoning districts within the Town of Meeker. Section 8.29.102 Definitions. As defined in this chapter, unless the context otherwise requires, the following terms, phrases, words and their derivation shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number; and every word importing the masculine gender only may extend to and be applied to females and things as well as males and every word importing the neuter gender only may extend to and be applied to natural persons as well as things. The word “shall” is always mandatory and not merely directory: “Amendment 20” means Article XVIII, §14 of the Colorado Constitution, adopted on November 7, 2000. “Colorado Medical Marijuana Code” means Part 1 of Article 43.3 of Title 12 of the Colorado Revised Statutes, C.R.S. §12-43.3-101, et seq. “Debilitating medical condition” means a condition described in Article XVIII, §14 (1)(a) of the Colorado Constitution. “Medical marijuana” means marijuana that is grown and sold pursuant to the provisions of the Colorado Medical Marijuana Code and for a purpose authorized by Article XVIII, §14 of the Colorado Constitution. “Medical marijuana center” means a person licensed pursuant to the Colorado Medical Marijuana Code to operate a business as described in C.R.S. § 12-43.3-402 that sells medical marijuana to registered patients or primary caregivers as defined in Article XVIII, §14 of the Colorado Constitution, but is not a primary caregiver, and which a municipality is authorized to prohibit as a matter of law. “Medical marijuana-infused product” means a product infused with medical marijuana that is intended for use or consumption other than by smoking, including but not limited to edible products, ointments, and tinctures. “Medical marijuana-infused products manufacturer” means a person licensed pursuant to the Colorado Medical Marijuana Code to operate a business manufacturing medical marijuana-infused products, and which a municipality is authorized to prohibit as a matter of law. “Medical use” means the acquisition, possession, production, use, or transportation of marijuana or paraphernalia related to the administration of such marijuana to address the symptoms or effects of a patient’s debilitating medical condition, which may be authorized only after a diagnosis of the patient’s debilitating medical condition by a physician or physicians, as provided Amendment 20. “Optional premises cultivation operation” means a person licensed pursuant to the Colorado Medical Marijuana Code to grow and cultivate medical marijuana for a purpose authorized by Article XVIII, §14 of the Colorado Constitution, and which a municipality is authorized to prohibit as a matter of law. “Patient” means a (natural) person who has a debilitating medical condition. “Person” means a natural person, partnership, association, company, corporation, limited liability company, or organization, or a manager, agent, owner, director, servant, officer, or employee thereof. “Physician” means a doctor of medicine who maintains, in good standing, a license to practice medicine issued by the state of Colorado. “Primary caregiver” means a natural person, other than the patient and the patient’s physician, who is eighteen years of age or older and has significant responsibility for managing the well-being of a patient who has a debilitating medical condition. Except, as provided by C.R.S. §25-1.5-106(3)(b)(I), the act of supplying medical marijuana or marijuana paraphernalia, by itself, is insufficient to constitute “significant responsibility for managing the well-being of a patient”, for purposes of determining a “primary caregiver”. Section 8.29.103 Medical Marijuana Centers, Optional Premises Cultivation Operations, and Medical Marijuana-Infused Products Manufacturer – Prohibited Uses. A. The operation of medical marijuana centers, optional premises cultivation operations or medical marijuana-infused product manufacturer or any sale facility, business or operation related thereto within the Town limits, which may be authorized under the Colorado Medical Marijuana Code, are hereby prohibited and unlawful. B. It shall be unlawful and a violation under this Chapter for any person to establish, operate, cause to be operated, or permit to be operated within the Town’s limits, and within any area annexed into the Town after March 15, 2011, a facility, business or any other operation under the Colorado Medical Marijuana Code as a medical marijuana center, optional premises cultivation operation, or as a medical marijuana-infused products manufacturer or any sale facility, business or operation related thereto. Section 8.29.104 Cultivation and Sale of Medical Marijuana – Prohibited A. As authorized by C.R.S. §12-43.3-103(2)(a), no person shall cultivate medical marijuana within the Town’s limits, unless such person does so as a registered patient or licensed primary caregiver, pursuant to and in accordance with C.R.S. §25-1.5-106. B. As authorized by C.R.S. §12-43.3-103(2)(a), no person shall sell medical marijuana within the Town’s limits, unless such person does so as a licensed primary caregiver, pursuant to and as provided by C.R.S. §25-1.5-106. Section 8.29.105 Patients and Primary Caregivers – Affirmative Defense – Limitation. A. Nothing in this Chapter shall be construed to prohibit, regulate, or otherwise impair the medical use of marijuana by a registered patient or the provision of medical marijuana by a licensed primary caregiver for his or her patients, provided that any such patient or primary caregiver is doing so in accordance with all applicable provisions of Amendment 20; the Colorado Medical Marijuana Code, as amended: C.R.S. §25-1.5-106, as amended; and the Town’s ordinances, and in accordance with any applicable rules and regulations promulgated under state law. B. Notwithstanding the provisions of this Chapter, it shall not be unlawful and it shall be an affirmative defense to criminal prosecution under the provisions of the Meeker Municipal Code, including, but, not limited to M.M.C. Title 9, the Offense Ordinance of the Town of Meeker, for a medical marijuana patient or primary caregiver to possess, use, or obtain medical marijuana, when such medical marijuana patient or primary caregiver is fully and currently compliant with all applicable state laws, regulations, and registration or licensing requirements concerning medical marijuana, provided that such medical use of marijuana is not in plain view of, or in a place open, to the general public; does not occur on property owned or possessed by the Town; or possess medical marijuana or otherwise engage in the use of medical marijuana in or on the grounds of a school or in a school bus, or as otherwise provided by Amendment 20 or C.R.S. §25-1.5-106. C. Notwithstanding the foregoing provisions, no person, including a patient or a primary caregiver, pursuant to or as provided by Amendment 20 or C.R.S. §25-1.5-106, shall be entitled to the protection of this section for his or her acquisition, possession, manufacture, production, use, sale, distribution, dispensing, or transportation of marijuana for any use other than medical use. Section 8.29.106 Penalty. A. A violation of any provision of this Chapter 8.29 shall constitute an ordinance offense punishable by a fine of not more than one thousand dollars ($1000.00) or imprisonment for a term not exceeding one (1) year, or both such fine and imprisonment. A person committing any such offense shall be guilty of a separate offense for each and every day, or any portion thereof, during which the offense is committed or continued to be permitted by such person, and shall be punished accordingly. B. Violations of this ordinance are declared to be a nuisance and the Town is specifically authorized to seek an injunction, abatement, restitution, or any other remedy necessary to prevent, enjoin, abate, or remove the violation. C. Any remedies provided for herein shall be cumulative and not exclusive, and shall be in addition to any other remedies provided by law or in equity. Section II. The Town Board hereby finds, determines, and declares that this ordinance is necessary and proper to provide for the safety, preserve the health, promote the prosperity, and improve the order, comfort and convenience of the Town and the inhabitants thereof. The recitals of this ordinance are hereby adopted by the Town Board as additional findings. Section III. Existing ordinances or parts or ordinances inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment or any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Ordinance No. 8, Series 2009 and Ordinance No. 6, Series 2010 are repealed hereby upon the taking effect of this ordinance. Section IV. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Town of Meeker hereby declares that it would have passed this ordinance, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. Section V. The Mayor and Town Clerk are hereby directed to execute this ordinance. Section VI. The codifier of the Meeker Municipal Code is hereby authorized to make such numerical and formatting changes as may be necessary to incorporate the provisions of this ordinance within the Meeker Municipal Code. The Town Clerk is authorized to correct, or approve the correction by the codifier, of any typographical error in the enacted regulations, provided that such correction shall not substantively change any provision of the regulations adopted in this ordinance. Such corrections may include spelling, reference, citation, enumeration, and grammatical errors. Section VII. In order to implement the Town’s authority pursuant to the Colorado Medical Marijuana Code to prohibit medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturer or prohibit the cultivation or sale of medical marijuana for the protection of the public health, safety and welfare of the Town, as soon as possible following the adoption of this ordinance by the Town Board, an emergency is declared to exist, and this ordinance is declared to be necessary for the immediate preservation of the public peace, health and safety. Wherefore, this ordinance shall be in full force and effect upon adoption of this ordinance on March 15, 2011, upon the adoption of this ordinance by an affirmative vote of three-fourths (3/4) of the members of the Town Board of Trustees.   • Mormon crickets have hatched near Rangely. They were all sighted on BLM land north of Hwy. 64 near the junction of CR 96 and CR 1, down a dirt road near the Moffat County line.  The picture shown was taken yesterday by Mary Meinen from Rangely. She says the crickets are about the size of a ladybug (less than 1/2”). Some of them are actually yellow in color but most of them are darker. They are milling around and getting ready to start moving soon. Note: Photo is not to scale.
Rio Blanco County and the White River and Douglas Creek Conservation Districts are still asking for your help to identify additional hatch-outs of crickets so that control efforts can be put in place. The success of the program will highly depend upon local landowners and the public helping to locate crickets as soon as they hatch.  See last week’s paper for a list of ways to help or contact the County Weed & Pest District at 970-878-9670 or the Conservation District office at 970-878-9838 with any questions.
