Since the operator will accept emissions limits less than 250 tons per year for each criteria pollutant, this source will be considered a synthetic minor source not subject to PSD review. AN ORDINANCE AFFIRMING THE MAY 16, 2006 MOTION OF THE TOWN BOARD OF TRUSTEES TO REZONE A CERTAIN PARCEL OF LAND IN THE SANDERSON HILLS SUBDIVISION OWNED AND DEVELOPED BY BERISLAV K. Sepic, the “Owners”, owned a certain parcel of real property known as the Sepic Development, more particularly described as: Lots 1,2,3,4, and a portion of Lot 5, of the Sanderson Hills Subdivision, as shown on the Plat thereof dated December 19, 1978, as reception #185454, and as more particularly described in the Quit Claim Deed filed for recording in the office of the Rio Blanco County Clerk and Recorder, on April 19, 2006, as Reception No. 284591, the “Subject Property”; and, WHEREAS, the Owners proposed to the Town a development plan for the Subject Property which provided for the construction of multi-family housing, a child day care facility and an assisted living facility which would necessitate the rezoning of the Subject Property to the Town’s MR Mixed Residential District and the Owners submitted a Town application requesting such a rezoning for the Subject Property; and, WHEREAS, on April 24, 2006, the Town Planning Commission held a public hearing concerning the requested rezoning of the Subject Property, notice of which having been duly given in the Rio Blanco Herald Times newspaper, and based upon the evidence presented at the public hearing, the Town Planning Commission recommended to the Town Board to approve the rezoning of the Subject Property to MR Mixed Residential District, as requested by the Owners; and, WHEREAS, on May 16,2006, the Town Board held a public hearing concerning the rezoning of the Subject Property as requested by the Owners, notice of which having been duly given in the Rio Blanco Herald Times newspaper, and based upon the Town Board’s consideration of the recommendation of the Town Planning Commission, the Town staff and the other evidence presented at the public hearing adopted and passed a motion to approve the rezoning of the Subject Property to MR Mixed Residential District; and, WHEREAS, thereafter, the Development and Security Agreement, between the Town and the Owners, provided for the Subject Property to be developed as proposed by the Owners which was consistent with the MR Mixed Residential District requirements including a mixture of multi-family residential uses, together with a child day care facility and an assisted living facility; and, WHEREAS, subsequent to the completion of the construction of a portion of the Sepic Development, the Town staff discovered that the formal action necessary to approve the rezoning of the Subject Property, to-wit: the adoption of a ordinance, had not been completed and it is the Town staff’s recommendation that the Town Board take final action to approve such an ordinance affirming the Town Board’s motion to rezone the Subject Property, for the reasons stated above; and, WHEREAS, a public hearing was held on January 19, 2010 before the Town Board at its regular meeting at the Meeker Town Hall, 345 Market Street, to which public hearing, public notice was duly given in the Rio Blanco Herald Times newspaper; and, WHEREAS, at the public hearing, the Town Board heard and considered the statements of the Town staff concerning the affirmation of the Town Board’s motion to rezone the Subject Property; and, WHEREAS, the Town Board on the basis of the evidence produced at the public hearing finds that the development plan for the Subject Property, as previously reviewed and approved by the Town Board and the Town Planning Commission, provided for multi-family residential uses together with other permitted uses: a child day care facility and assisted living facility, are consistent with the requirements of the MR Mixed Residential District and that it is appropriate and in the best interests of the Town to affirm the Town Board’s motion to rezone the Subject Property as MR Mixed Residential District by the adoption of an ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN OF MEEKER BOARD OF TRUSTEES that: Section I.
