The application pertains to the existing Colowyo Coal Mine, Permit No. C-1981-019, Colowyo Coal Company L.P., 5731 State Highway No. 13, Meeker, Colorado 81641, filed with the Colorado Division of Reclamation, Mining and Safety (CDRMS), Colorado Department of Natural Resources, 1313 Sherman Street, Room 215, Denver, Colorado 80203,and approved by the Division on April 5, 2013 (latest Permit Renewal). The Colowyo Mine is located approximately 28 miles south of Craig, Colorado. The application areas for Phase III bond release were reclaimed from 2000 through 2003. These areas total approximately 209 acres that are shown in detail on Map 1 within the application. The status of the reclaimed areas is consistent with the requirements of the approved reclamation plan which includes achievement of Phase I and Phase II bond release, a minimum of 5 years since the last seeding and rill and gully repair, and the reclamation parcels have met the requirements of the revegetation success criteria for two years. Listed below is a general legal description of this area: Township 3 North, Range 93 West of the 6th P.M. Section 3 NW SE , SW NE ; Section 4 NW SE , NE NW ; Section 10 SE , NW ; Section 11 SW W Colowyo currently holds a self-bond (Bond No. SB-010) in the amount of $80,517,829. With this bond release application, the Colowyo Mine will be requesting relinquishment of 100% of the bond held for the parcels applied for under this application. ORDINANCE NO. 04-2016
AN ORDINANCE AMENDING THE MEEKER MUNICIPAL CODE; REPEALING THE REGISTRATION OF LARGE ANIMALS, AMENDING MAINTENANCE AND RIGHT-OF-WAY SECTIONS DEALING WITH WEEDS, MOWING, AND SNOW.
WHEREAS, the Board of Trustees has determined it to be reasonable and necessary to amend the Municipal Code; and WHEREAS, certain sections were incorporated that are no longer applicable or enforceable and should be amended to be fully enforceable and clear; and WHEREAS, the Board of Trustees conducted a public hearing on this request on July 5, 2016; and WHEREAS, the Board of Trustees hereby acknowledges that changes shall take effect immediately following the subsequent publication requirement and 30-day time period of this action as mandated by law; and WHEREAS, the Board of Trustees has determined it to be reasonable and necessary to amend and update the Town of Meeker Municipal Code Chapter Sections; 6.3.106, 8.20.104, 8.20.108, 8.20.105 and 10.5.101, and that such amendments and updates are in the best interests of the citizens of the Town of Meeker to promote the legitimate public purposes of the health, safety and welfare of the Town of Meeker and the inhabitants thereof.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER AS FOLLOWS: Chapter 6.3.106 – Registration of Animals shall be repealed in its entirety. Chapter 8.20.104 – Public nuisance declared; keeping of junk; cutting and removal of weeds; sagebrush exception, subsection (c) shall be amended to read as follows: “All weeds and grass shall be cut and removed by all persons, described in Section 8.20.105 of this Chapter, from all lots or tracts of land, excluding Ute Park, RR-A zoned parcels, and large tracts or lots of undeveloped property in excess of 2 1/2 acres, by the 20th of June; and all lots or tracts of land that require removal of grass or weeds under this Section shall be properly mowed and maintained to keep growth to a length of no greater than a height of 12″ at all times.” Chapter 8.20.105 – Maintenance by landowners and users shall be amended to read as follows: “All owners, tenants, occupants, developers and users of every lot or tract of land within the Town shall be responsible for keeping and properly maintaining such lot or tract of land, which shall include their half of alleys and/or all right-of-way behind any street and/or right-of-way areas to the sides of such property considered right-of-way, free and clear at all times of any and all weeds, grass, and/or snow from sidewalks or walkways, brush, trash, junk and rubbish of all kinds.” 4. Chapter 8.20.108 – Notice to remove; form shall be amended to replace the section wording and shall read as follows: “Such written notice as is provided for in Section 8.20.107 shall be in the following sequence: A) First Notice: a Door Hanger warning notice or written letter, including Town Logo and affixed signature of Code Officer identifying violation and corrective action required and Town’s contact information. B) Second Notice: written letter including information relating to next steps and penalties for failure to comply. C) Citation to Municipal Court: issued anytime following 14 days after either the First or Second Notice identified herein is mailed. The Second Notice set forth above shall be in substantially the following form: If you fail to remove any and all such weeds, brush, trash, junk and rubbish of all kinds, then the Town of Meeker may take either or both of the following actions: Issue you a citation, causing you to appear inMunicipal Court where you may be fined and/or penalized in accordance with 8.20.115 – Violation; penalty. Cause the removal to be done by any means at the Town’s disposal and shall assess the whole cost thereof, including fifteen percent (15%) for inspection and other incidental costs in connection therewith, upon such lot and/or tract of land. This assessment when levied shall be and constitute a lien against such lot or tract of land until paid by you and shall have priority over all other liens except general taxes and prior special assessments. In case you do not pay such assessment within a period of Thirty (30) days, the Town has the power and authority to certify to the Rio Blanco County Treasurer such assessment, with directions to the Rio Blanco County Treasurer to collect the assessment, together with a ten percent (10%) penalty for costs of collection, in the same manner asother taxes are collected. The laws of the State of Colorado for assessment and collection of general taxes, including the laws for the sale and redemption of property for taxes, shall apply to the collection of such assessment.” 5. Except as specifically modified herein the remaining provisions of the Meeker Municipal Code shall remain in full force and effect. 6. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.
EFFECTIVE DATE This Ordinance shall take effect thirty days after its publication as provided in C.R.S. 31-16-105. INTRODUCED, PASSED, APPROVED AND ADOPTED on July 5, 2016, by a vote of 5 for and 0 against, and ordered published in full in the Rio Blanco Herald Times.

The CBOE will render a decision no later than August 5th, 2016, based on the written material they have been given and on presentations made during the hearing.
