PRESS RELEASE FOR IMMEDIATE RELEASE SEPTEMBER 1, 2013 REQUEST FOR PROPOSALS The Victim Assistance and Law Enforcement Board of the 9TH Judicial District, which is Garfield, Pitkin and Rio Blanco Counties, is seeking grant applications from agencies and organizations to provide assistance services to crime victims. The funding cycle is January 1-December 31, 2014. The board is committed to funding programs which provide direct services to crime victims and implement the Victims’ Rights Amendment. They may also consider scholarships for training that is related to the welfare of victims. Revenue for this fund is generated from a surcharge or fees assessed to people who are convicted of felonies, misdemeanors, traffic offenses and fish and game violations. These funds are authorized by Title 24, Article 4.2, Colorado Revised Statutes. During the 2013 grant cycle the board awarded a total of $397,000 to 13 agencies that provide services to victims in the 9th Judicial District. It is anticipated that approximately $350,000 will be available for the 2014 12-month grant cycle. TOWN OF MEEKER ORDINANCE NO. 05-2013 AN ORDINANCAN ORDINANCE PROHIBITING THE RETAIL SALE OF MARIJUANA WHEREAS, Colorado voters approved an amendment to the Colorado Constitution, Article XVIII, Section 16, which allows in part for the retail sale of marijuana in the State of Colorado; and WHEREAS, Article XVIII, Section 16, of the Colorado Constitution authorizes local governments, such as the Town of Meeker to prohibit the operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, or retail marijuana stores through the enactment of an ordinance; and WHEREAS, C.R.S. 12-43.4-104(3) authorizes a local jurisdiction, such as the Town of Meeker, to enact ordinances or regulations prohibiting the operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, or retail marijuana stores; and WHEREAS, the Town of Meeker Board of Trustees has considered comments and testimony offered by members of the public at a public meeting on September 3, 2013, as well as any additional comments offered at the public meetings where this ordinance was considered; and WHEREAS, the Board of Trustees has carefully considered the provisions of Article XVIII, Section 16, of the Colorado Constitution, the impact of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities and retail marijuana stores on the health, safety, and welfare of the Town and the citizens thereof, the costs of regulation balanced against the potential revenues from sales tax proceeds, and has determined that marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities and retail marijuana stores should not be located within the corporate limits of the Town. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO AS FOLLOWS: Recitals. The foregoing recitals are incorporated herein as findings and determinations of the Board of Trustees. Amendment. The Board of Trustees hereby amends the Meeker Municipal Code by the adoption of a new Chapter 8.30 as follows: Chapter 8.30 Retail Marijuana 8.30.101 Purpose and applicability. (a) Colorado voters approved an amendment to the Colorado Constitution, Article XVIII, Section 16, which allows in part for the retail sale of marijuana in the State of Colorado. The Colorado Retail Marijuana Code, located in C.R.S. 12-43.4-101 et al., states that it is unlawful under state law to cultivate, manufacture, distribute, or sell retail marijuana and retail marijuana products, except in compliance with the terms, conditions, limitations, and restrictions Article XVIII, Section 16, of the Colorado Constitution, and the Colorado Retail Marijuana Code. Article XVIII, Section 16, of the Colorado Constitution authorizes local governments, such as the Town of Meeker, to prohibit the operation of retail marijuana stores through the enactment of an ordinance. C.R.S. 12-43.4-104(3) authorizes a local jurisdiction, such as the Town of Meeker, to enact ordinances or regulations prohibiting the operation of retail marijuana establishments including retail marijuana stores. The purpose of this Chapter is to prohibit within the Town such retail marijuana stores as provided for within the Colorado Retail Marijuana Code. (b) This Chapter is necessary to protect and is enacted in furtherance of the public health, safety and welfare of the Town and its inhabitants. (c) This Chapter is intended to apply and shall apply to any and all property, businesses, conduct, activity or business entities operating within the Town, whether stationary, mobile or virtual. (d) This Chapter and all the prohibitions herein are intended to apply and shall apply in any and all zoning districts within the Town. 8.30.102 Definitions. As defined in this Chapter, unless the context otherwise requires, the following terms, phrases, words and their derivation shall have the meanings given herein: Mobile distribution center means any vehicle other than a common passenger light-duty vehicle with a short wheel base used to carry a quantity of marijuana greater than one ounce. Person means a natural person, partnership, association, company, corporation, limited liability company, or organization; except that “person” does not include any governmental organization. Retail marijuana means marijuana as defined in Section 16(2)(f) of Article XVIII of the Colorado Constitution, that is cultivated, manufactured, distributed, or sold by a licensed retail marijuana establishment. Retail marijuana cultivation facility has the same meaning as “marijuana cultivation facility” as defined in Section 16(2)(h) of Article XVIII of the Colorado Constitution. Retail marijuana establishment means a retail marijuana store, a retail marijuana cultivation facility, a retail marijuana products manufacturer, or a retail marijuana testing facility. Retail marijuana products means “marijuana products” as defined in Section 16(2)(k) of Article XVIII of the Colorado Constitution that are produced at a retail marijuana products manufacturer. Retail marijuana products manufacturer has the same meaning as “marijuana product manufacturing facility” as defined in Section 16(2)(j) of Article XVIII of the Colorado Constitution. Retail marijuana store has the same meaning as defined in Section 16(2)(n) of Article XVIII of the Colorado constitution. Retail marijuana testing facility means “marijuana testing facility” as defined in Section 16(2)(l) of article XVIII of the Colorado Constitution that is licensed pursuant to this article. 8.30.103 Marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores prohibited. It is unlawful for any person to operate, cause to be operated, or permit to be operated, any marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores within the Town, and all such uses are hereby prohibited in any location within the Town, or within any area hereinafter annexed to the Town. 8.30.104 Penalty. A violation of any provision of this Chapter shall be punishable by a fine of not more than $1,000 or imprisonment for not more than one (1) year, or by both such fine and imprisonment. Each and every day a violation of the provisions of this Chapter is committed, exists, or continues shall be deemed a separate offense. The Town is authorized to seek an injunction, abatement, restitution or any other remedy necessary to prevent, enjoin, abate or remove the violation; and Any remedies provided for herein shall be cumulative and not exclusive and shall be in addition to any other remedies provided by law or in equity.
