MEEKER I District Court Judge Daniel Petre granted a motion for continuance in the case against Neil Joy. The motion was made by Gordon Gallagher, defense attorney for Joy.
Joy, 31, is charged with reckless manslaughter, a Class 4 felony, in the Aug. 5, 2011 shooting death of James (Jeb) Eben Berthelson, 32. Joy is also charged with misdemeanor possession of a firearm while under the influence of alcohol or a controlled substance. Joy has been out on bond since the arrest.
Charges were filed Aug. 19 by Ninth Judicial District Attorney Martin Beeson, who requested the motion for continuance be denied, a plea entered by Joy and the case set for trial.
Judge Petre granted the motion so the defense can get test results from the Colorado Bureau of Investigation.
The case continues for an entry of plea until Jan. 27, 2012.
