The effort to recall sitting commissioner Gary Moyer has entered the court system, further delaying a decision on whether the recall effort will go to a public vote anytime soon. In September 2021, Matt Scott filed a district court civil case against Rio Blanco County Clerk and Recorder Boots Campbell.
Court documents state the case “challenges the Statement of Sufficiency erroneously issued by the Clerk for a petition to recall Gary Moyer as Rio Blanco County Commissioner, District 1 and a complaint for violation of the plaintiff’s “due process rights under the Colorado and United States Constitutions.” The case is scheduled for a “setting” hearing on Nov. 18 by telephone, according to the 9th Judicial District Court docket.
