The update on the Moyer recall is as follows: the Moyer Recall Committee is awaiting judicial review before the recall can go before voters on a ballot. The attorney hired by Matt Scott filed a lawsuit in Rio Blanco District Court challenging the decision made by Boots Campbell, the Rio Blanco County Clerk and Recorder. Scott’s attorney is disputing approximately 325 signatures that appeared on both petitions. The district judge now has the task of interpreting Senate Bill 250—a revised law with major changes concerning recalls—that was enacted during the time the second recall effort was already in progress. The hearing is set for Jan. 24, 2022, in Rio Blanco District Court.
Election law states that any special election has to occur 60 days after the Nov. 2 election. We are still on schedule unless the Moyer team continues its delay tactics denying the people of Rio Blanco County their right to recall and opportunity to vote on this issue.
