ORDINANCE NO. 2013 – 01 THE BOARD OF COUNTY COMMISSIONERS OF RIO BLANCO COUNTY, COLORADO AN ORDINANCE AN ORDINANCE PROHIBITING THE OPERATION OF MARIJUANA CULTIVATION FACILITIES, MARIJUANA PRODUCT MANUFACTURING FACILITIES, MARIJUANA TESTING FACILITIES AND/OR RETAIL MARIJUANA STORES WITHIN THE UNINCORPORATED AREAS OF RIO BLANCO COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Rio Blanco County, Colorado (“Board”) has the authority to exercise all of the powers of a county for the unincorporated areas of Rio Blanco County pursuant to Section 30-11-103, C.R.S.; and WHEREAS, on November 6, 2012, the voters of Colorado approved the adoption of Amendment 64, amending Article XVIII of the Constitution of the State of Colorado by the addition of new Section 16, Personal Use and Regulation of Marijuana; and WHEREAS, Amendment 64 became effective upon official declaration of the vote thereon by proclamation of the Governor, pursuant to Section 1(4) of Article V, of the Constitution of the State of Colorado; and WHEREAS, paragraph 5(f) of Section 16 of Article XVIII of the Constitution of the State of Colorado provides that the County may prohibit the operation of marijuana cultivation facilities, product manufacturing facilities, marijuana testing facilities, and/or retail marijuana stores through the enactment of an ordinance; NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF RIO BLANCO COUNTY, COLORADO, FINDS AS FOLLOWS: A. The public hearing before the Board was extensive and complete, pertinent facts, matter, and issues were submitted, and any interested parties were given an opportunity to be heard at the hearing; B. The record is complete; C. The Board finds, determines, and declares that this Ordinance is necessary and proper to provide for the safety, preserve the health, promote the prosperity, and improve the order, comfort, welfare and convenience of Rio Blanco County and the inhabitants thereof. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF RIO BLANCO COUNTY, COLORADO, AS FOLLOWS: 1. Unless otherwise specified or the context otherwise requires, any terms used in this Ordinance shall have the same meanings as defined in Section 16 of Article XVIII of the Constitution of the State of Colorado. 3. This Ordinance shall be enforced by the Rio Blanco County Sheriff. 4. It shall be unlawful for any person to violate any provision of this Ordinance. 5. The fine for a first offense and any subsequent offense shall be One Thousand Dollars ($1,000.00) per violation, and each day is a separate violation. 6. Unless otherwise provided by law all fines and penalties and any surcharges thereon, for the violation of this Ordinance shall be paid into the treasury of Rio Blanco County. 7. In addition to the fines and penalties described in this Ordinance, any person convicted of a violation of this Ordinance shall be subject to the statutory surcharge of Ten Dollars ($10.00) for the Victims and Witnesses Assistance and Law Enforcement Fund. This surcharge shall be paid to the Clerk of Court by each person convicted of violating this Ordinance. The Clerk of Court shall transmit the money in accordance with Section 30-15-402(2) C.R.S. 8. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The Board of County Commissioners of Rio Blanco County, Colorado declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase, or portion herein, despite the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions would be declared invalid or unconstitutional. BY-PASS ARRANGEMENTS, JUMPER CONNECTIONS, REMOVABLE SECTIONS, SWIVEL OR CHANGEOVER DEVICES AND OTHER TEMPORARY OR PERMANENT DEVICES THROUGH WHICH OR BECAUSE OF WHICH BACKFLOW CAN OR MAY OCCUR ARE CONSIDERED TO BE CROSS-CONNECTIONS. 3.3 CROSS-CONNECTION-CONTROLLEDMEANS HAVING AN ACCEPTED CROSS-CONNECTION CONTROL DEVICE PROPERLY INSTALLED AND MAINTAINED. THIS DEVICE SHALL CONTINUOUSLY PROVIDE CROSS-CONNECTION PROTECTION COMMENSURATE WITH THE DEGREE OF HAZARD. 8.
