WHEREAS, on November 6, 2012 the voters of the State of Colorado approved “Amendment 64”, which added Article XVIII, Section 16 to the Colorado Constitution, and created a limited exception from criminal liability under Colorado law for the cultivating, manufacturing, or testing of marijuana or marijuana products, and retail stores selling marijuana or marijuana products, unless prohibited by a local government, and such operation of such facilities in a system of licensed establishments regulated by State and local governments; and WHEREAS, Amendment 64 directed the Colorado Department of Revenue to issue regulations for marijuana establishments, meaning marijuana cultivation facilities, marijuana testing facilities, marijuana product manufacturing facilities, and marijuana retail stores, so that the State of Colorado can begin accepting applications by October 1, 2013; and WHEREAS, Amendment 64 directs that local regulations for such businesses must also be in place by October 1, 2013, but that there is a local option in Amendment 64 that authorizes the Town Council to adopt an ordinance banning, opting out or prohibiting the retail sale, cultivation, product manufacturing, and testing of marijuana within the corporate limits of Rangely; and WHEREAS, a majority of the voters of the Town of Rangely supported the prohibitions of the retail sale, cultivation, manufacturing, and testing of marijuana in Rangely, Colorado in the past election by a majority vote against the passage of Amendment 64; and WHEREAS, retail marijuana operations remain illegal under federal law as a Schedule I controlled substance, and the response of federal law enforcement authorities to Article XVIII, Section 16 of the Colorado Constitution remains uncertain; and WHEREAS, the Rangely Town Council previously passed Ordinance 2010-11 establishing a moratorium on any new medical marijuana establishments, thus exercising the local option pertaining to medical marijuana establishments; and WHEREAS, the Rangely Town Council previously passed Ordinance 674 (2012) and 676 (2013), which were ordinances imposing a temporary moratorium on the operation of marijuana establishments pursuant to Amendment 64, which moratorium was temporary in nature due to the emergency nature of the ordinance, and which ordinances are set to expire by its own terms on or before October 1, 2013; and WHEREAS, the Rangely Town Council, as an exercise of its local land use authority, adopts a new section of Chapter 15 (Zoning) entitled Article VII “Marijuana, Operation of Commercial Marijuana Establishments Prohibited”; and WHEREAS, the Town Council has authority to act under the following provisions: Article XVIII, Section 16 of the Colorado Constitution; the Local Government Land Use Control Enabling Act, Article 20 of Title 29, C.R.S.; Part 3 of Article 23 of Title 31, C.R.S., concerning municipal zoning powers; and Sections 31-15-103, 31-15-401 and 31-15-501, C.R.S., concerning municipal zoning powers; and WHEREAS, the Town Council determines that the duration of the ban on retail marijuana establishments shall last until the Town Council takes further formal action, if any, by ordinance after having an opportunity to consider any potential challenges to Article VIII, Section 16(5)(f) of the Colorado Constitution, the state regulations governing retail marijuana operations, and the position of the federal government; and WHEREAS, the Rangely Town Council finds and determines that this Ordinance is necessary for the protection of the health, welfare and safety of the community and that the prohibition of the retail sale, cultivation, manufacturing and testing of marijuana within the corporate limits of Rangely is in the best interest of the citizens of the Town of Rangely. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF RANGELY, COLORADO: Section 1. Recitals. The foregoing recitals are incorporated herein as findings and determinations of the Rangely Town Council. Section 2. Title 15 of the Rangely Municipal Code is amended by the addition of Article VII, as follows: Article VII Marijuana, Operation of Commercial Marijuana Establishments Prohibited Section 321 Purpose. It is the intent of this Section to prohibit certain land uses related to marijuana in the Town and in furtherance of this intent, the Town Council makes the following findings: A. Article XVIII, Section 16 of the Colorado Constitution (“Amendment 64”) specifically authorizes the governing body of a municipality to “prohibit the operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, or retail marijuana stores through the enactment of an ordinance.” B. Based on careful consideration of Article XVIII, Section 16 of the Colorado Constitution and the potential secondary effects of the cultivation and dispensing of marijuana and the retail sale, distribution and manufacturing of marijuana-infused products, such land uses have an adverse effect on the health, safety and welfare of the Town and its inhabitants. Section 322 Definitions For purposes of this ordinance, the terms “marijuana” and “marijuana products” shall have the same meaning as defined in subsection (2) of Section 16 of Article XVIII of the Colorado Constitution, as specifically stated below. “Marijuana” or “Marihuana” means all parts of the plant of the genus cannabis whether growing or not, the seeds thereof, the resin extracted from any part of the plant, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or its resin, including marihuana concentrate. “Marijuana” or “Marihuana” does not include industrial hemp, nor does it include fiber produced from the stalks, oil, or cake made from the seeds of the plant, sterilized seed of the plant which is incapable of germination, or the weight of any other ingredient combined with marijuana to prepare topical or oral administrations, food, drink, or other product. “Marijuana Cultivation Facility” means an entity licensed to cultivate, prepare and package marijuana and sell marijuana to retail marijuana stores, to marijuana product manufacturing facilities, and to other marijuana cultivation facilities, but not to consumers. “Marijuana Establishment” means a marijuana cultivation facility, a marijuana testing facility, a marijuana product manufacturing facility, or a retail marijuana store. “Marijuana Product Manufacturing Facility” means an entity licensed to purchase marijuana; manufacture, prepare and package marijuana products; and sell marijuana and marijuana products to other marijuana product manufacturing facilities and to retail marijuana stores, but not to consumers. “Marijuana Products” means concentrated marijuana products and marijuana products that are comprised of marijuana and other ingredients and are intended for use or consumption such as, but not limited to, edible products, ointments and tinctures. “Marijuana Testing Facility” means an entity licensed to analyze and certify safety and potency of marijuana. “Retail Marijuana Store” means an entity licensed to purchase marijuana from cultivation facilities and marijuana and marijuana products from marijuana product manufacturing facilities and to sell marijuana and marijuana products to consumers. Section 323 Prohibition of Marijuana Establishments A. Marijuana establishments, including marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores are prohibited within the Town of Rangely. B. Marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores may not be operated as a primary land use, or as an incidental activity to another lawful use, or as a home occupation. C. The Town designates the Town Clerk as the office responsible for processing applications for licenses to operate a marijuana establishment. Pursuant to the prohibitions set forth above, any application for a license to operate a marijuana establishment shall be deemed denied upon the date of submission. Section 324 Penalties A. Violations of this section shall constitute a code infraction violation and shall be punishable as follows: 1. By a fine of not more than three hundred ($300.00) dollars, or imprisonment in the county jail for not more than ninety (90) days, or by both such fine and imprisonment. 2. Each and every day that a violation of the provisions of Sections 321, 322 and 323, Title 15, Article VII is committed, exists or continues shall constitute a separate offense. B. The establishment, operation and continuation of any activity in violation of the terms of this Sections 321, 322 and 323, Title 15, Article VII is specifically determined to constitute a public nuisance, may be abated by the Town as a nuisance and may be enjoined by the Town in an action brought in the District Court of Rio Blanco County. The remedies set forth in this section shall not be exclusive, shall be cumulative and shall be in addition to any other remedy available at law or in equity. Section 3. Severability. If any part of this ordinance is invalidated for any reason, it shall not affect the validity of the remaining portions of this ordinance. Section 4.
Effective Date. This ordinance shall be effective thirty (30) days after publication following final passage. Section 5. Publication of Summary. The Town Council deems it appropriate to publish the title of this ordinance, together with a summary of the ordinance and with a statement that the text is available for public inspection and acquisition in the office of the Town Clerk.
