PRESS RELEASE FOR IMMEDIATE RELEASE SEPTEMBER 1, 2013 REQUEST FOR PROPOSALS The Victim Assistance and Law Enforcement Board of the 9TH Judicial District, which is Garfield, Pitkin and Rio Blanco Counties, is seeking grant applications from agencies and organizations to provide assistance services to crime victims. The funding cycle is January 1-December 31, 2014. The board is committed to funding programs which provide direct services to crime victims and implement the Victims’ Rights Amendment. They may also consider scholarships for training that is related to the welfare of victims. Revenue for this fund is generated from a surcharge or fees assessed to people who are convicted of felonies, misdemeanors, traffic offenses and fish and game violations. These funds are authorized by Title 24, Article 4.2, Colorado Revised Statutes. During the 2013 grant cycle the board awarded a total of $397,000 to 13 agencies that provide services to victims in the 9th Judicial District. It is anticipated that approximately $350,000 will be available for the 2014 12-month grant cycle. ORDINANCE NO.13-02 (Series of 2013) AN ORDINANCE OF THE TOWN OF DINOSAUR, COLORADO ESTABLISHING A TEMPORARY MORATORIUM ON THE OPERATION OF MARIJUANA CULTIVATION FACILITIES, MARIJUANA PRODUCT MANUFACTURING FACILITIES, MARIJUANA TESTING FACILITIES, RETAIL MARIJUANA STORES, AND MARIJUANA CLUBS WHEREAS, pursuant to Sections 31-15-401 and 31-23-301, C.R.S., the Town of Dinosaur has broad authority to exercise its police powers to promote and protect the health, safety and welfare of the community and its residents; and WHEREAS, pursuant to Section 31-23-301, C.R.S., such police powers include the power to regulate the location and use of land within the Town for trade, industry, or other purposes; and WHEREAS, pursuant to the Local Government Land Use Control Enabling Act of 1974, Sections 29-20-101 et. seq., C.R.S., the Town of Dinosaur has the authority to plan for and regulate the planned and orderly use of land on the basis of the impact thereof to its residents; and WHEREAS, on November 6, 2012, Colorado voters approved Amendment No. 64, now codified as Section 16 of Article XVIII of the Colorado Constitution; and WHEREAS, pursuant to Amendment No. 64, a “locality”, defined to include a municipality, may “prohibit the operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, or retail marijuana stores through the enactment of an ordinance”; and WHEREAS, registered electors of the Town of Dinosaur will be entitled to vote on the question of permitting the establishment of retail marijuana businesses in the Town of Dinosaur; and WHEREAS, the Town Council of the Town of Dinosaur finds and determines that a moratorium on commercial marijuana establishments will allow Town staff and the Town Council the time to investigate the Town’s ability to permanently regulate retail marijuana establishments, to monitor actions taken by the federal government, if any, in regard to Amendment No. 64, and to consider and potentially develop appropriate regulations as directed by the Town Council; and WHEREAS, the Town Council hereby determines that temporarily suspending the establishment and operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, retail marijuana stores, and marijuana clubs is in the best interest of the health, safety and welfare of the Town of Dinosaur and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF DINOSAUR, COLORADO: Section 1. Incorporation of Recitals. The foregoing recitals are hereby affirmed and incorporated herein by this reference and as findings of the Town Council. Section 2. Temporary Moratorium and Delay Enacted. Upon the effective date of this Ordinance, the Town of Dinosaur hereby imposes a temporary moratorium and delay on the acceptance, processing and approval of all applications for any Town of Dinosaur permit, license or any other application pertaining to the operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores, as those terms are defined in the Colorado Retail Marijuana Code, Article 43.4 of Title 12, C.R.S., as well as marijuana clubs. For the purposes of this Ordinance, a “marijuana club” means any place of private assembly for the purpose of inviting members and their guests to use or consume marijuana and/or marijuana products on the premises of any commercial, office, or industrial zoned property except for those spaces which are occupied as residential uses. This temporary moratorium and delay shall automatically terminate at midnight on the 60th day following certification of the November 5, 2013 election results if a majority of the electors voting in such election vote to permit the establishment of such businesses in the Town of Dinosaur, or if a majority of the electors vote not to permit the establishment of such businesses, such temporary moratorium shall expire on January 1, 2015, unless terminated earlier by the Town Council or extended in its duration by enactment of another ordinance. This Ordinance and the temporary moratorium and delay herein imposed shall be self executing without further action by the Town or the Town Council. Section 3. Designation of Town Clerk as Authority in Regard to State Licensing of Retail Marijuana Establishments. The Town Clerk is hereby designated as the Town of Dinosaur s authority with regard to the State licensing of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores. So long as this Ordinance remains in effect, the Town Clerk is authorized and directed to notify the Colorado Department of Revenue, from time to time as necessary, that the establishment of new marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana testing facilities, and retail marijuana stores are not permitted within the Town of Dinosaur. Section 4. Severability. If any provision of this Ordinance should be found by a court of competent jurisdiction to be invalid, such invalidity shall not affect the remaining portions or applications of this Ordinance that can be given effect without the invalid portion, provided that such remaining portions or applications of this Ordinance are not determined by the court to be inoperable. The Town Council declares that it would have adopted this Ordinance and each section, sentence, clause, phrase or a portion thereof, despite the fact that any one or more sections, sentences, clauses, phrases or portions would be declared invalid or unconstitutional.
