PUBLIC NOTICE
Pursuant to Title 34, Article 33, Paragraph 118, of the Colorado Revised Statutes, the Colorado Division of Minerals and Geology hereby issues notice that an application to renew the Deserado Mine Permit No. C-1981-018 for a five-year term, submitted by Blue Mountain Energy, Inc., 3607 CR 65, Rangely, CO 81648, was deemed complete for the purpose of filing. All review and comment periods as provided in the Act and Regulations promulgated thereunder initiate from this day of filing.
The total permitted acreage is 13,645.01, of the permit area it contains some 13,325.01 acres of federal land and 320 acres of private land. These areas are situated in T2N, R101W and T3N, RlOlW, 6th P.M, in Rio Blanco County about 8 miles northeast of the Town of Rangely. It includes lands containing all of RBC Road 65, eastern part of RBC Road 96, and western portions of RBC Road 78, and southern end of MC Road 61. The Deserado Mine Permit area lies within USGS 7.5 minute Quadrangle maps entitled “Rangely NE” and “Cactus Reservoir”.
A copy of the permit revision application is available for public inspection at the Town Clerk’s office, Town Hall in Rangely. 2019 Rio Blanco County Bridge Maintenance Project. OIL AND GAS CONSERVATION COMMISSION

NOTICE OF PROPOSED
UNDERGROUND INJECTION CONTROL PERMIT
AND DESIGNATION OF THE
ENTRADA FORMATION AS AN EXEMPT AQUIFER
TO ALL INTERESTED PERSONS AND TO WHOM IT MAY CONCERN:
The purpose of this notice is to solicit public comment on an aquifer exemption required for the Entrada Formation (Lower Jurassic) in the S.B. Lacy 11Y a Class II disposal well proposed by Chevron USA Incorporated (“Chevron”). The well is being converted from a Rangely Weber Sand Unit production well to an injection well for disposal of produced Weber fluids in the overlying Entrada Formation. The S.B. Lacy 11Y was drilled at a location 1030 feet from the south line and 410 feet from the east line of Section 23, Township 2 North, Range 103 West, 6th P.M., Rio Blanco County, Colorado. The well is slightly directional and bottoms just into the SW ¼ of the SW ¼ of Section 24. The S.B. Lacy 11Y, drilled originally a Weber production well, has not produced since at least January 1999.
Class II injection wells are permitted and regulated in such a manner as to prevent the contamination of underground sources of drinking water and to ensure fluid emplacement and confinement within the permitted injection zones. Class II injection wells are permitted to inject waste generated from oil and gas exploratory and production operations.
Chevron proposes to inject waste fluids into the Entrada Formation through perforations at depths from 4,440 to 5,053 feet MD (Measured Depth). A water sample from the Entrada formation in the J.E. Pepper 1 (aka A-1) well 7.5 miles to the east had a Total Dissolved Solids (“TDS”) concentration of 7,141 mg/L (milligrams per Liter). An aquifer exemption is required if TDS values are less than 10,000 ppm. Designation as an Exempt Aquifer means that Entrada water is not suitable as a source for a public water supply.
Based on the data supplied by the operator, the Entrada would qualify as an Exempt Aquifer under this Commission’s Rule No. 324.B.a. in that:
The Entrada does not currently serve as a source of drinking water: and
The Entrada cannot now and will not in the future serve as a source of drinking water because:
The Entrada is situated at a depth and location which makes recovery of water for drinking water purposes economically or technologically impractical.
The Entrada is so contaminated that it would be economically or technologically impractical to render the water fit for human consumption.
The total dissolved solids content of the groundwater is more than 3,000 and less than 10,000 mg/L and is not reasonably expected to supply a public water system.
The Entrada does not currently serve as a source of drinking water in this area. According to the Colorado Division of Water Resources there are no drinking water wells within at least 1 mile of the proposed injection well. There are three water well permits issued within one mile of the S.B. Lacy 11Y. These wells were used as Rangely Field water-supply wells in the past; one is now plugged and abandoned, one has been converted to a Weber injection well, and one has been converted to Weber production.
Rangely, Colorado gets an adequate supply of drinking water from the White River. The current supply is adequate. U.S. Census information suggests that Rangely, population 2,000-2,500, is not growing therefore it is unlikely additional drinking water will be needed. There are no other cities in the area that would be interested in the Entrada as a drinking water source. Therefore it is not reasonable to expect Entrada water to be used to supply a public system or an individual drinking water well.
Construction of a water well to the depth of the Entrada Formation at 4,440 ft MD would have to include drilling, surface casing, 1st string casing, cement, wellhead equipment, pumps, and fuel. Chevron estimates the cost to drill and complete a well in the Entrada Formation to be approximately $700,000 +/-20%. They also estimate that transportation of Lacy 11Y water to the Rangely Water Treatment Plant might cost $1,250,000. Finally any Entrada water pumped from the S.B. Lacy 11Y would have to be treated to remove the TDS content therefore incurring additional costs. The sum of these costs would be prohibitive for the City of Rangely given the availability of potable water from the White River.
The Entrada in the S.B. Lacy 11Y well should be granted an Aquifer Exemption. The injection zone is thousands of feet below the surface and there are no existing drinking water wells in the area. The Entrada injection zone has a high TDS concentration, to use it as drinking water it would have to be treated. The cost of drilling a well, transporting water to the water treatment plant, and finally treating it is not thought to be reasonable given the population of the City of Rangely. Currently the City of Rangely has an adequate supply of drinking water.
If approved the Entrada aquifer exemption will include: Township 2 North, Range 102 West, 6th P.M. Rio Blanco County, Colorado; all of the SE¼ of Section 23, the W½ and SE¼ of the SW¼ of Section 24, the NW¼ of the NW¼ of Section 25, and the NE¼ of the NE¼ of Section 26. The area covers approximately 360 acres or nine quarter-quarter sections and lies completely within the Rangely Weber Sand Unit boundary.
Public comments are encouraged and will be accepted, in writing at the Commission for a period of thirty (30) days after publication of this notice. If any data, information, or arguments submitted during the public comment period appear to raise substantial questions concerning this proposed injection well permit or the accompanying aquifer exemption, the Director may request that the Commission hold a hearing on the matter.
If, within thirty (30) days after publication of this notice, the Commission does not receive a hearing request which indicates there is a significant degree of public interest in a hearing on the designation of the aquifer exemption and the disposal well permit is approved, then the Entrada Formation in the limited area described herein shall be considered exempt.
