Provide a detailed outline of what has been done toward completion or for completion of the appropriation and application of water to a beneficial use as conditionally decreed including expenditures: Applicant has undertaken the following specific activities over the last six years that demonstrate its diligence with regard to the subject conditional rights. The explanation of work accomplished during the diligence period is not all inclusive but is merely representative. Unless otherwise noted, the expenditures listed herein do not include attorney’s fees or salaries of staff of the River District but the Applicant does claim those significant expenses toward diligence. Legislation and Administrative Regulations. The River District conducted extensive lobbying activities, at the federal and state levels, on a wide variety of statutory and regulatory issues related to water rights, water use, and environmental matters, as those matters relate to the construction of water projects and uses of water within Colorado, including: Participation in numerous rulemaking hearings and informal processes before the Water Quality Control Commission to ensure that the state’s water quality regulations protect the ability of water users to place water to beneficial use. Salinity Control. The River District continues to participate and fund efforts to reduce the salinity of the Colorado River, as well as the operation of the Colorado River mainstem reservoirs to ensure to the River District, as well as to the State of Colorado, an adequate supply of water from the Colorado River, including its tributaries, as guaranteed by the Colorado River Compacts. USGS Gaging. The River District participates in the funding of United States Geological Survey gauging stations throughout the District in order to better assess the availability of water for development pursuant to its various projects. CWCB Grant. The River District has contracted with the Colorado Water Conservation Board to study storage options in the White River basin. Included in this study and evaluation are the Strawberry Creek and Wray Gulch water rights identified in paragraph III above. The study is being funded by a $220,800 grant with inkind and monetary contributions in excess of $40,000 from the Yellow Jacket Water Conservancy District and the River District. The River District has contracted with The Yellow Jacket Water Conservancy District and the Applegate Group, Inc., to facilitate completion of the study. The study is ongoing and includes but is not limited to: an assessment of water demands within the White River basin. The purpose of this assessment is to guide the River District and Yellow Jacket District in planning for water demands within the basin; an assessment of any obvious environmental or permitting challenges associated with the construction of the Strawberry Creek and Wray Gulch water rights; an assessment of legal and physical water availability; a reconnaissance level, current, cost estimate for building the projects as well as a preliminary current geotechnical analysis for each of the water rights that are the subject of the Study. Energy Development Water Needs Assessment. In 2008-2011, the River District directed a multi-phased study funded by the Colorado and Yampa-White River Roundtable to assess water use associated with energy development in the Colorado, White, and Yampa River basins. A great deal of energy development is occurring in the White River basin. The water rights that are the subject of this Application, when constructed, will be utilized, in part, to serve those water demands. Nontributary Produced Groundwater Rulemaking and Associated Legislation. During the diligence period the River District participated extensively in a rulemaking proceeding by the State Engineer to assist in his administration of wells that dewater geologic formations, including a number of formations in the White River basin, by withdrawing nontributary ground water to facilitate or permit the mining of minerals. The River District’s participation in this rulemaking was to ensure that its water rights, including those that are the subject of this Application, and the water rights of its constituents were protected. Additionally, the River District actively participated in legislation regarding the production of nontributary groundwater associated with the mining of minerals to ensure that its interests and the interests of its constituents were adequately protected. Water Rights Litigation. The River District has opposed numerous water right applications during the diligence period in order to prevent or mitigate adverse effects to its water rights. Water Marketing Program. During the diligence period, the River District has been actively engaged in the operation of its Water Marketing Program. While the water rights utilized in the Water Marketing Program are not the subject of this Application, the successful operation of the Water Marketing Program and the receipt of lease revenues by the River District will assist the River District in developing other water projects in Division 6, including projects such as those that are the subject of this Application. Expenditures. In addition to extensive staff time, the District expended in excess of $2.25 million in furtherance of the activities described herein. On April 4, the Meeker Lions Club installed new shelving units for the New Eden Pregnancy Care Center. New Eden asked the Lion’s Club to help them come up with more storage for items within the building, and the Lion’s Club raised money to purchase shelves. OPAL MUNGER PHOTO
