SNOW TALK WORD OF CAUTION YIELD RIGHT-OF-WAY TO SNOW PLOWS Town of Meeker Public Works personnel have experienced, during past snow seasons, potentially dangerous situations caused by citizens plowing snow from private driveways and parking lots into Town streets leaving snow ridges, which freeze on the roadway. When a snowplow hits frozen ridges on roadways, the snowplowing equipment may hydroplane making it difficult to control the equipment. The Town encourages snow removed from parking lots and driveways be stored on the owner’s property when possible. If snow must be removed to the street, please remove all ridges, leaving the street surface smooth. If an accident results from poor snow removal practices, the person creating the condition may be responsible. The Town further requests that while crews are loading snow onto trucks in the downtown area, that drivers avoid driving in that block if possible. Under State Law, while snow removal equipment is displaying a flashing yellow or blue light and is engaged in snow removal, all other vehicles should exercise due care and caution in approaching and passing such equipment. Any snow removal equipment displaying the yellow or blue flashing light has the right-of-way at all intersections and may not be required to yield the right-of-way to other traffic, as required by the traffic control signs, or comply with other restrictions governing traffic flow. Please use due care by slowing down at each intersection and looking for snow plowing equipment before entering the intersection. Please treat intersections as four way stops if you can’t see clearly both ways due to snow piles or other obstructions. Your safety is important to us! Thank you for your cooperation. Legal Notice Opportunity to Comment on Blanco Lower Fawn and Moeller Creek/Lost Park grazing allotments Environmental Assessment. The White River National Forest, Blanco Ranger District has prepared an Environmental Assessment (EA) to address the environmental consequences of a proposed agency action to continue to authorize cattle and horse livestock grazing on the Lower Fawn and Moeller Creek/Lost Park Cattle and Horse (C&H) grazing allotments. The LowerFawn and Moeller Creek/Lost Park C&H grazing allotments are located on the north side of the Blanco Ranger District, northeast of the town of Meeker, Colorado, on National Forest System lands within White River Plateau of northwest Colorado. They are found by the general legal description of Township 2 North, Range 90 West, portions of Sections 22, 23, 26, 27, 33-35, Township 1 North, Range 91 West, portions of Sections 11-14, 23, 24 and 26, and Township 1 North, Range 90 West, portions of Sections 3-10, and 15-19. Elevation ranges from 7,400 – 9,000 ft. These grazing allotments encompass 11,179 acres. The Proposed Action (Alternative 3) would continue to permit livestock grazing within the Lower Fawn and Moeller Creek/Lost Park Allotments Analysis Area under an Adaptive Management strategy that would meet or move toward desired conditions identified in the 2002 White River National Forest Revised Land and Resource Management Plan and on a site-specific level. Adaptive management is a process that uses focused monitoring information to determine if management changes are needed, and if so, what changes and to what degree. It is a process that allows the Forest Service to manage for changing conditions and new information over time. It gives the authorized officer the flexibility to implement change within the constraints imposed by the EA and subsequent decision. Currently, 485 cow/calf pairs are permitted on the allotment from early July through early October for a total of 1961 permitted AUMs. The preferred alternative includes the analysis of effects of potential future management options and a change in grazing timing and duration in selected pastures with grazing to begin later in July. If selected, the proposed action will be incorporated into the Oak Ridge/Lost Park Coordinated Resource Management Plan which will serve as the Allotment Management Plan for the Lower Fawn and Moeller Creek/Lost Park grazing allotments. ORDINANCE NO. 6, Series 2010 AN EMERGENCY ORDINANCE EXTENDING THE IMPOSITION OF A TEMPORARY MORATORIUM ON THE SUBMISSION, ACCEPTANCE, PROCESSING, AND APPROVAL OF ANY APPLICATION FOR A TOWN OF MEEKER PERMIT OR LICENSE RELATED TO THE OPERATION OF A BUSINESS THAT SELLS MEDICAL MARIJUANA; DIRECTING THE INVESTIGATION OF THE TOWN’S REGULATORY AUTHORITY OVER SUCH BUSINESSES; DECLARING THE INTENTION OF THE TOWN BOARD TO CONSIDER THE ADOPTION OF APPROPRIATE TOWN REGULATIONS WITH RESPECT TO SUCH BUSINESSES IF PERMITTED BY LAW; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in 2009, the Town of Meeker Board of Trustees, the “Town Board”, adopted Ordinance No. 8, series 2009, imposing a temporary moratorium on the submission, acceptance, processing, and approval of any application for a Town of Meeker permit or license related to the operation of a business that sells medical marijuana, referred to as a medical marijuana dispensary; and, WHEREAS, during the period of the Town’s moratorium, House Bill 10-1284 enacting C.R.S. 12-43.3-102 was adopted, authorizing municipalities to adopt and enforce an ordinance licensing, regulating and prohibiting the cultivation or sale of medical marijuana, the “Colorado Medical Marijuana Code”; and, WHEREAS, the Colorado Medical Marijuana Code regulates medical marijuana on a state-wide basis; introduces the concept and terminology of “medical marijuana center”, rather than “medical marijuana dispensary”; establishes a dual local and state licensing scheme for medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers; authorizes local regulation and licensing requirements that are more stringent than those set forth in said Code; and authorizes a “local option” by which the Town Board or the registered electors of the Town may vote to prohibit the operation of medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturers licenses: and, WHEREAS, C.R.S. 12-43.3-202(1)(b)(I) provides that a municipality “that has adopted a temporary moratorium regarding the subject matter of this article shall be specifically authorized to extend the moratorium until the effective date of the rules adopted by the department of revenue”; and, WHEREAS, the Town Board finds that extending the Town’s temporary moratorium from its original expiration until July 1, 2011 will allow the Town Board and the Town staff additional time to investigate the Town’s ability to regulate such medical marijuana operations as provided by the Colorado Medical Marijuana Code; to investigate the development of appropriate regulations or pursue the exercise of the local option as provided by the Colorado Medical Marijuana Code and the draft and final rules of the Department of Revenue; and, WHEREAS, the Town Board has been advised by the Town staff that, to date, the Town has not received any inquiries from persons interested in opening and operating businesses related to medical marijuana centers, optional premises cultivation operations, or medical marijuana-infused products, therefore, no person will be unduly prejudiced by the extension of the temporary moratorium; and, WHEREAS, the Town Board finds that it is necessary, appropriate, and serves the best interests of the citizens of the Town to extend the temporary moratorium on the submission, acceptance, processing, and approval of any applications for Town permit, licenses and certificates of occupancy relating to the sale, distribution, production or cultivation of medical marijuana, as described herein and by the Colorado Medical Marijuana Code. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER, COLORADO: Section I. The above and foregoing recitals are incorporated herein by reference and adopted as findings and determinations of the Town Board. Section II. Upon the adoption of this ordinance the Town extends the temporary moratorium, as provided by Ordinance 8, series 2009, upon the submission, acceptance, processing, and approval of all applications for permits, licenses or certificates of occupancy related to a medical marijuana dispensary. This moratorium applies without limitation to medical marijuana dispensaries, as well as, to medical marijuana centers, optional premises cultivation operations, medical marijuana-infused products and medical marijuana-infused products manufacturers, as defined in the Colorado Medical Marijuana Code. Section III. During the period of the temporary moratorium set forth in this ordinance the Town staff is directed to study, develop, review and evaluate appropriate recommendations and regulations pertaining to medical marijuana dispensaries, medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products and products manufacturers, as defined in the Colorado Medical Marijuana Code, for presentation to and consideration by the Town Board, to include the evaluation of the effect of the Colorado Medical Marijuana Code and related rules and regulations upon the Town’s authority to regulate and license such medical marijuana businesses described herein. Furthermore, during the period of the temporary moratorium, no Town staff, board, or commission shall accept any application for filing, processing or review for any use permit, variance, building permit, or other applicable entitlement for any use pursuant to the Meeker Municipal Code from any persons for the operation of any business involving medical marijuana, as described in this ordinance and the Colorado Medical Marijuana Code. Section IV. The Town Board hereby finds, determines, and declares that this Ordinance is necessary and proper to provide for the safety, preserve the health, promote the prosperity, and improve the order, comfort and convenience of the Town and the citizens thereof. Section V. The provisions of this ordinance are temporary in nature and may be repealed by a subsequent ordinance or legislative enactment, including a repeal to correspond to the effective date of the Department of Revenue regulations. The temporary moratorium enacted herein shall terminate on July 1, 2011, unless sooner repealed. Section VI. It is the intention of the Town Board that each separate provision of ordinance shall be deemed independent of all other provisions therein. If any section, subsection, sentence, clause, phrase, or any portion thereof is for any reason held invalid or unconstitutional by any court of competent jurisdiction, each subsection, sentence, clause, phrase, or any portion thereof shall be deemed a separate, distinct, independent provision, and such holding shall not affect, impair, or nullify the validity of the remaining portions thereof. SECTION VII. In the event the provisions of this ordinance are inconsistent or in conflict with any other provisions of the Meeker Municipal Code, then the provisions of this ordinance shall be controlling. Section VIII. The Town Board finds, determines and declares that passage of this ordinance is necessary for the immediate preservation of the public peace, health and safety in order to prevent a person from filing an application for a Town permit, variance, license or certificate of occupancy or other applicable entitlement for use pursuant to the Meeker Municipal Code relating to the operation of medical marijuana dispensaries, medical marijuana centers, optional premises cultivation operation, and medical marijuana-infused products and products manufacturers, as defined in the Colorado Medical Marijuana Code or as described herein in this ordinance. Failure to immediately impose the temporary moratorium provided for in this ordinance will potentially allow acquisition of certain rights with respect to sale or cultivation of medical marijuana or other operations as described in this ordinance, before the Town has had the reasonable opportunity to consider appropriate regulations thereof. This ordinance shall be effective upon its adoption.
