TOWN OF MEEKER ORDINANCE NO. 06-2012 AN ORDINANCE OF THE TOWN BOARD OF TRUSTEES OF THE TOWN OF MEEKER ELECTING THE EXCLUSIVE LOCAL REVIEW PROCESS FOR LIQUOR LICENSE SPECIAL EVENT PERMIT APPLICATIONS AS AUTHORIZED BY COLORADO SENATE BILL 11-066 (C.R.S. 12-48-107(5)) WHEREAS, pursuant to Articles 46, 47 and 48 of Title 12 of the Colorado Revised Statutes, the Town of Meeker, Colorado (“Town”) possesses the authority to license and regulate, concurrently with the state of Colorado, the service and sale of alcoholic beverages within the Town; and WHEREAS, during its last regular legislative session, the Colorado General Assembly adopted Senate Bill 11-066 (“SB 11-66”) which amended Article 48 of Title 12, C.R.S., governing liquor license special event permits; and WHEREAS, SB 11-66 grants local liquor licensing authorities the option to assume exclusive local control over and responsibility for the issuance of said special event permits within their respective jurisdictions; and WHEREAS, the Town Board of Trustees of the Town of Meeker (“Board”) finds and determines that the current process for issuing a special event permit, which requires both state and local approvals, is redundant and often excessively time consuming for applicants; and WHEREAS, the Board further finds that Town staff possess the necessary resources, time and expertise to process special event permit applications and render decisions thereon in accordance with applicable law; and WHEREAS, the Board finds that electing for exclusive local control over the special event permitting process, as authorized by SB 11-66, will provide a more efficient review of such applications without adversely affecting the quality or thoroughness of such review; and WHEREAS, the Board therefore desires to elect to assume exclusive local control over the issuance of liquor license special event permits. NOW THEREFORE, IT IS ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MEEKER AS FOLLOWS: Section 1. SPECIAL EVENT LIQUOR PERMITS A. Pursuant to C.R.S. 12-48-107(5)(a) the Town Board of the Town of Meeker, acting as the local liquor licensing authority, hereby elects to exercise exclusive local control over the issuance of liquor license special event permits for events within the Town, The preceding recitals are adopted as specific findings and determinations of the Board of Trustees. B. The provision of this section notwithstanding, the Town Clerk, or designee, shall report to the Colorado Liquor Enforcement Division, within ten (10) days after the Town issues any special event permit, the name of the organization to which the permit was issued, the address of the permitted location, and the permitted dates of alcohol beverage service. C. Upon receipt of an application for a special event permit the Town Clerk, or designee, shall, as required by C.R.S. 12-48-107(5)(c), access information made available on the web site of the state licensing authority to determine the statewide permitting activity of the organization applying for the permit. The Town shall consider compliance with the provisions of C.R.S. 12-48-105(3) limiting to fifteen (15) the number of special event permits issued in anyone year to anyone organization, before approving any application. In addition, before approval, the Town Clerk, or designee, shall confirm the following when appropriate: (1) For special event licenses: (a) Timely and proper posting of a conspicuous public notice sign as required by Article 48, Title 12, C.R.S., as amended. (b) Whether the applicant satisfies the eligibility criteria set forth in Article 48, Title 12, C.R.S., as amended. (c) After investigation, no sufficient grounds for denial appear to exist and no protests have been filed by affected persons. (d) That the applicant has not exceeded and does not propose to exceed the maximum number of special event calendar days permitted by Article 48, Title 12, C.R.S., as amended. (e) Each application for a special event permit shall be accompanied by an application fee in an amount equal to the local licensing fee established by C.R.S. 12-48-107(2). Section 2. Effective Date. This Ordinance shall be in full force and effect from and after its publication as required by law.
